Changes coming November 19th

Canada Gazette – GOVERNMENT NOTICES

Main points
- LMIA no longer worth 600 points, only worth 200 for NOC 0 or 50 for NOC A/B. Points will also be awarded for jobs offers without LMIA.
- Bonus points for Canadian education
- 90 days to submit application after ITA

I'm guessing that this is intended to level the playing field a bit - I suspect most people who have got through EE have an LMIA so far.

Curious to know how this will work for a job offer without an LMIA. Does that mean simply that if the person can get the company to give them an offer in writing that they are good to go with the extra points?

Points for qualifying offer of arranged employment
29 (1) If a foreign national has a qualifying offer of arranged employment, they may be assigned points as follows:

(a) 200 points, if the offer is for employment in an occupation contained in Major Group 00 of the National Occupation Classification; or
(b) 50 points, if the offer is any other qualifying offer of arranged employment.

I think this is the relevant part

(ii) the foreign national holds a valid work permit, the offer of employment is made by an employer for whom the foreign national currently works and who is specified on the work permit, the work permit was issued based on a positive determination made by an officer under subsection 203(1) of the Regulations with respect to the foreign national’s employment with that employer in an occupation that is listed in Skill Type 0 Management Occupations or Skill Level A or B of the National Occupational Classification matrix and the assessment provided by the Department of Employment and Social Development on the basis of which the determination was made is not suspended or revoked, or
(iii) the foreign national holds a valid work permit issued under the circumstances described in paragraph 204(a) or (c) or section 205 of the Regulations, the offer is made by an employer who is specified on the work permit and the foreign national works for that employer and has accumulated at least one year of full-time work experience, or the equivalent in part-time work, over a continuous period of work for that employer;

Thanks for the heads up that's so depressing currently waiting for LMIA to go through as I'm a plumber I'll only get 50 points now. Does anyone have any experience with Pnp?

It will depend on which EE route you apply under

Federal Skilled Worker, Federal Skilled Trades or Canadian Experience Class and Provincial Nomination.
IMHO if eligible and the fact that you already have a job in Canada and the company want to keep you and you meet the eligibility for EE then I think its easier for those already here on IEC.

Yes we are just waiting to complete a years work experience in march and hopefully a permanent job offer and not a contract then we will be applying. Hopefully it will make it easier although losing the 600 points doesn't sound too good

Just checking, but you're aware you'd have needed a LMIA to get the 600 points? Just a job offer isn't enough, so your employer would have had to apply for that, and from reading the link it seems they still will have to if you want to claim points for arranged employment.

You may already have this sorted, but as a LMIA can take several months to obtain and you're planning on applying in January, I just thought I'd mention it just in case.

Apparently if you go down the PNP route you still get 600 points so I've been told, don't give up...look into it

Yes we are aware regarding the LMIA number. I think we need to sit down with a lawyer and see what they say our options are

Good news for those on work permits as TFWs. Will be interesting to see where the points go now. Less people needing LMIA = lower points but more in pool could mean higher points.
