Catch 22 - Police records check
 
So I received the email asking for my Police check (from Hong Kong). On following the link and finding the details of what is needed it seems I may be stuck in a Catch 22.

1. I entered Canada under dual intent while awaiting the decision on our application.
2. Hong Kong police require "ink and roll" paper finger prints produced by the local police where I am (so Canada). They will not accept prints from any other agency or a third party compay and they will not accept a print out of digital finger prints.
3. For obvious Covid reasons the RCMP/local police will not do "ink and roll" prints (and they won't supply a letter stating that they won't supply them).

I have got a print out of digital prints and will submit those. I have contacted the Hong Kong Police about the issue but am not expecting to even get a decision before the deadline expires.

So my question is, if I can't get a police check from Hong Kong do I just submit a letter to immigration explaining why? Do I need a specific form?

From the IRCC websiteIf you’re unable to get a police certificate from a country, you’re responsible to show why you can’t get one.

To prove that you can’t get a police certificate, you must:
  • show proof that you requested a police certificate from the correct authorities and
  • write a letter explaining all the efforts you have taken to get one
Even if you send us the above items, this is not a guarantee of acceptance.

According to Hong Kong Police website FAQ's you may be able to use digital (live scan) fingerprints..

Shall I take the fingerprints with ink or electronically?
A.15 Fingerprints taken with ink or via live scan (i.e. electronically) are both acceptable. If your fingerprints are taken via a live scan device, a hard copy must be generated so the fingerprint card can be mailed to our office. Please be reminded of the certification we required on the fingerprint card, such as the police station stamp.

How can I obtain a set of fingerprints overseas for CNCC application?
A.14 Usually overseas police station / law enforcement agency / Consulate would help with the fingerprint taking. If your full set of fingerprints is taken by other agencies appointed by the abovementioned authorities, a proof of the appointment is also needed for verification purpose.
and you may be misinterpreting the 3rd party .. as I read it, it says you can't use an old (previously used) set of fingerprints


Can I submit a fingerprint card which was processed by another party before?
A.16 No. Fingerprint cards previously processed by another party will not be accepted.
