You do still need to apply. The difference is she already has the job offer for her application, so you don't need to wait as you would with the IEC. You can apply when she applies for her work permit (presumably the company will just apply for both for you if it's a transfer).

So the company when transferring her (I'm not working in that company) can also apply for my work permit? Will it be processed together or I will have a separate processing time?

Yes, they can apply for both at the same time. And should do if it's a company transfer, they'll just do all the visa side of things which would be for both of you. Processed together, you may not get them back at exactly the same time but it shouldn't be hugely different.

You could even apply at POE.

The difference with IEC is that it's an open work permit, so she wouldn't have a job offer when it's issued, hence she needs a job before you can apply. Whereas most 'normal' work permits she'd get the job first, and then apply for the work permit, so with any of those you can apply for your spousal open work permit at the same time, as she already has a job offer when applying. Does that make sense?

Do look in to her eligibility for the intra-company transfer TWP (Wiki link above), not all jobs qualify, she will need to be quite specialised. So it may be that the IEC is an easier option.

Thank you. That makes sense. I've checked on a canada.ca website and they are saying that if the employee is a specialist or in the senior position it can be transferred then.
Also what is POE?

POE - Port of Entry. I.e. the airport when you arrive.

Does that mean that I can apply on the POE and the processing time will be shorter than 8 weeks?

If eligible to apply for a work permit at a port of entry then the work permit is issued within minutes/hours on arrival.

That sounds very interesting, so my wife even on IEC can find work and after the first payslip I can just apply for a work permit on POE and omit online 168 days of waiting?

Not exactly. If a person arrives on the IEC then that person is issued an open work permit with some restrictions. Any spouse/partner is not issued with a work permit on entry. Once the IEC work permit holder gets a job in a certain class of job then the other person can then apply for an open work permit but not at a POE as they are already in Canada.

Yes, you'd just need to take proof of her job - and it's recommended that you wait for payslips, so you might be better off just applying via paper (quicker than online - currently approx 60 days).

Yes providing you meet the requirements to apply at a POE and have proof of spouse being employed in that class of job and copy of her work permit etc.

So basically that would be very fast. I'm just doing a trip to States and on POE applying for a work permit based on my wife's work permit and I can get it issued in hours? I mean that sounds very good, like super good. It means that for 2 months less I will be unemployed.
