Default Can you included a non dependant child in PR Application?

Hi

Is it possible to include a non dependant 21 year old on your PR application? Our daughter is currently working in Canada under the IEC programme but the visa finishes in April, if she is does not get her second year granted she will have to leave Canada.

No I don't believe you can include her, I think she has to be either in full time education or living with you to be classed as dependant.

Dependent children

A son or daughter is dependent when the child:
•is under the age of 22 and does not have a spouse or common-law partner;
•is over the age of 22 and has been continuously enrolled as a full-time student and depended substantially on the financial support of a parent since before the age of 22;
•became a spouse or a common-law partner before the age of 22 and has been continuously enrolled as a full-time student and depended substantially on the financial support of a parent since becoming a spouse or common-law partner, or
•is over the age of 22 and depended substantially on the financial support of a parent since before the age of 22 because of a physical or mental condition.

Adding to what FL stated, provided she meets the criteria that FL specified, as long as your application is received prior to her 22nd birthday she will continue to be classified as a dependent for PR provided she does not marry or live with anyone regardless of how long the process takes. The age is locked in to the date of receipt of application by CIC.

5.4. Lock-in age of dependent children

The lock-in of age for dependent children is the day CPC-M receives a completed IMM 1344AE and correct processing fees. Dependent children must be less than 22 years of age when the sponsorship application is received. Under 22 years means up to and including the last day before the dependent child's 22nd birthday. Offices must date-stamp application forms as soon as they are received.

My son was 5 days off his 22nd birthday when CIC received my application with him as my dependent - he did not actually obtain PR until just before he was 27, but was still classed as dependent as he was not married nor living in a common law relationship.

Age is locked in, but dependency isn't. And from what OP has said, it sounds as though her daughter would not be considered a dependent child after the age of 22 as she is living independently and not financially dependent on them, or in full-time education.
