Can I get my H1 stamped in Canada

Default Can I get my H1 stamped in Canada

Hi,
I am in US on H1-B visa. But my passport still has F1 stamp. I am
landing at Toronto soon and I want to come back to US in a week. Can I
get my H1 stamped in Canada since Canada is my home country now? Or do
I have to go to my original country (India) to get it stamped. I
cannot reenter US without getting my H1 stamped.

Any inputs in this regard will be appreciated.

why cant you get back without a stamp ? You dont need one if you have old
I-94 and 797 approval and stay in Canada less than 30 days.

Hi,
Do you mean that I can reenter US even if I do not have a stamp on
my passport. Mine is not a revalidation. I still have F1 stamp on
which I originally entered Us. And now I am on H1.

wouldn't they take my I-94 when I leave US?

that's correct. i once went to canada (vancouver) ways back --- about 6 years ago to get the stamping but the consulate said i can only have it done in my country of origin. but then i returned without any problem, the following day, presenting my I-94 and the approval notice. i went to india after a couple of years and then got my visa stamped. so u shouldnt have a problem.

Things have changed now 6 years ago, those were the old good days!

I wouldn't risk it. I'm in exactly the same situation as you are. I was advised by many not to risk it, especially if you have a middle eastern background

Hi Singh

Yes you can get H1 stamped in Canada. Get an appointment with the US
consulate (www.nvars.com). If you have a US degree its quite easy for
u to get the stamp. Take all you documents (H1 docs, financial
statement of ur employer, recent pay stubs, degree certificates,
transcripts etc).

Please also call the US consulate in Toronto and the Visa Appointment
Reservation System (NVARS) for more information.

You may need to set up an appointment to get a H1-B visa stamp from
the consulate in Toronto. Canadian permanent residents can go to the
US Consulate in Canada for visa stamping. It may take 2-4 weeks to get
the Visa stamp, if you are required to obtain security clearance
(fingeprinted).
