Can I apply CitizenShip ?
 

HI, all,

I have stayed Canada for three years.

But I have a problem.

In 2001, I had a case (my wife called 911) and got conditional
discharged with one-year probation.
I am a good taxpayer for last three years

My questions are:

1) Because I am discharged, so need I to claim the probation in my
apply?

2) Can I apply citizenship now or waiting to next years? The
Citizenship Act said:
21. Notwithstanding anything in this Act, no period may be counted
as a period of residence for the purpose of this Act during which a
person has been, pursuant to any enactment in force in Canada,(a)
under a probation order;....

3) If I want to apply in this year, how can I do?

Periods on probation don't count towards meeting residency requirements for
citizenship eligibility.

Was it a Probation Order or a Peace Bond. Get a copy of the court record and
see what it says.

Not sure about Canada, but in the UK a fiscal delinquent would have
difficulty meeting the good character requirement for citizenship.

I remember it was a Probation. Does it have any other probation?

If I apply court to remove the discharge recorder, do I still need to
wait another year?

There is a big difference between taxes paid or not paid and fiscal
delinquency. If you have been convicted of tax evasion, or fraud, then
that's one thing, but having not paid your taxes yet without attempt to
evade is another.
