Default Berto,Miller One Doubt

Sir

Is there any chance that old cases filed before or on Decenber 31st 2001 can be
processed very fastly hereafter because of the reason of tough immigration laws there
won't be much applications will be filed immedieatly ot for some time as the grid and
points and laungauage ability in 2 official launguages are high.

Your view is appreciated

Don't count on it. New law is tougher for many but is also opening the opportunity to
apply to about 2 - 3 times more people than the old law, so the number of
applications coming in will not be any smaller. More - new law will not make the
existing backlog (in some visa posts few years long) suddenly disappear and pending
applications will continue to be processed. It will take at least 12 to 18+ months at
best (and much longer in visa posts where backlog is few years long) to see any
reduction of processing times as a result of new law - it will be rather slow and
gradual change, nothing sudden...

I agree with you.But if you take GOL Elimination point of view what you said is I
agree.There is a definite possibility that the filing of applications more than 2 to
3 times compared to old rules. But if you take the points grid and the laungauage and
the years of Education point point of view definetly i feel that there won't be
applications filled 2 or 3 times
i)Because see they allocated 22 points for trade certificate or diploma certificate
who has 15 years of Education.In the most part of the world the eligibilty for
the trade schools or non university courses are not 12th grade.You can see lot of
appliocants holding 2 or 3 year diploma but most of them are not having 15 years
of education.How come these people apply with out having sufficient points.

ii)Though you are holding 15 years of education Bachleor's but if you not prove you
are good in french then you will loose points and there is a risk for applying
and those who are not married or not having ties with canada either by family or
by Other means like not having job offer or not enrolled in Canadian University
or spouse qualifications in Canada.These things will make all the majority
applicants feel that they won't score sufficient points.

iii)Even in your early replies those who are having maximum points for
education,age,work and english launguage with no knowledge in French still scores
72 points.With risk of lacking 3 points How come the applicants take risk of
applying thinking that visa officer will approve my case because she is having
power to approve even if you are lacking points .People won't take that much risk
by spending money knowing that they are still lacking points.

1v)In other words those who are having maximum points for education.Points for
English and age and etc will have to go or attend classess for french and they
just can't learn french by undergoing 2 days weeks courses.They have to take
proper courses and have to undergo fromal course and to get certificats in that
you have to get excellent grades to prove you are too good in French That won't
happen in a single months or two.

v)You cannot see people scoring full 16 points if you are from the non English
speaking countries . Because the english asseent and words will completely differ
and you can definetly find difference .

So if you assess based on the above points definetly there won't be much applications
filed intilally or for some time .That is what all feel the points and selection are
made high and tough just to make

the new applicatnts tough so that in the maen time they can clear the old back logs
at the earliest.I know it is not possible to clear the old applications in One month
or two.But it depends on The visa office size and the total number of staff etc.

I think if you look at the number of people that will be able to qualify as a
percentage of those who used to apply, you will find out how many potential
applicants there will be.

Immigration currently has enough inventory/backlog/waiting list to cover about
2-3 years.

The purpose of these new regulations, particularly retroactivity and a high pass
mark, was to control the flow and really to eliminate backlog.

I for one certainly hope these can be accomplished as a fast and efficient process
will ultimately be better for everyone.

(And, I know that I was complaining about it earlier but while I still believe it to
be unfair, it is the only way to bring about some order since it is clear that no
more resources will be given to the department)
