I'm a landed immigrant in Canada for the past 2 yrs now. My country of citizenship is
Philippines.

I lived for 7 yrs in the U.S. and was on H1 for 6 yrs. Overstayed for 1 yr before
landing in Canada by land in June 1999. My wife, overstayed in the U.S. for 8 yrs.

We have a baby girl who is almost 2 yrs old & is a Canadian citizen.

What are our chances of getting approved for a visitor's visa? Since we have
overstayed in the U.S. prior. We just wanted to go & visit friends & family.

If denied a visitor's visa, will we be banned from entering the U.S. for a visit once
we're Canadian citizens?

I have a full time IT job, house, car in Toronto.

Any answers or suggestions is greatly appreciated. Thanks.

You should have no problem at all in getting entry into the US.

Your best bet would be to fly into the US, but even the drive should be smooth.

Just make sure you have your documents with you - proof of car, job and house.

Though I am a Canadian PR and have driven and flown into the US many times for both
business an pleasure, the US immigration officer asks usually the following
questions:

1. Where do you live ?
2. What is your citizenship ?
3. What is your status ?
4. Why are you going to the US ?
5. How long will you stay in the US ?

If the answers do not satisfy him, he might ask you:

Do you have a job ? where ? Do you have a house ?

Although I always carry documents to show the proof, always the officer has trusted
me and never asked me to show any of the documents.

But I still carry all the papers, just in case they wish to see it. Its better than
driving 5 hours to home and back !

Your overstaying in the US could be a problem, but the officers usually will not ask
you such questions. But that is a risk you might have to take, at the most they can
refuse entry.

In my lifetime I have done Canada US border crossing over 20 times both on
tourist/visitor visa as well as a landed immigrant.
