Default American to Canada--IT Consultant--Canadian Wife

I am an American Citizen living in the U.S. with my wife who has a green card and is
a Canadian Citizen. We are contemplating moving back to Canada around the end of
2003. I need some advice on the ways that we could enter canada. I am assuming that
since my wife/son are canadian citizens, there would be no issue for them to go to
Canada, right? The only issue is me.

1. NAFTA. I realize I could get into Canada using a Nafta visa since I do IT
consulting. My only concern is that I would be dependent upon that job to keep
my status in Canada, and I would rather be an independent contractor. What are
the limits as to who can offer a job under the TN visa? Could I set up my own
corp (or have my wife or bro-in law do it), and then have it offer me ajob?
Seems not right....

2. FAMILY. My understanding is that family class requires her to be in canada to
petition for me to return, so that would be out of the question, right?

3. SELF-EMPLOYED. I am leaning towards going the self-employed visa route.

I calculated points from canada’s website:

Age: 10 Education: 20 English/French: 16 Work Experience: 25 (Computer systems
analyst) Prearranged Job: 0 Adaptability: 10 Total: 81—just passing

Does that seem like the best route?

Thanks.

Hi:

The best route for you to take, is to have your wife apply to sponsor you. As a
Canadian citizen, she can apply to sponsor you while she is physically outside
of Canada.

Before you can apply for a temporary employment authorization pursuant to NAFTA, you
must obtain a job offer from an employer in Canada, and you must always qualify as a
"professional". The job offer must be bona fide.

Further, under the new regulations, only immigrants who have the intention and
ability to make artistic, cultural, or athletic contributions and self-employed
farmers are eligible to apply as Self-Employed Immigrants. Therefore, IT
professionals generally have a difficult time qualifying under the
Self-Employed category.

Yours truly, Ingrid Y. Chen, B.A., LL.B.
