Default adopting children from UK.

A Number of years ago we agreed to be guardians of a friends children if the worst should happen and both parents were to die.
We now live in Canada as permenant residents.

If the worst should happen and our friends should both die would we be able to bring there two children to live with us in Canada? Could we adopt them or sponser them?

Any ideas as to how we would stand with this issue?

1. If the parents die, you would have to adopt (assuming that you are not related) and then sponsor the children. You should read the following http://www.cic.gc.ca/english/immigra...tion/index.asp It is quite a complicated process depending on the province where you reside.

How would this situation work when the children in question are your neice and nephew? We have a similar agreement with ours.

You should discuss with a good family law practitioner in your province of residence, then look at the immigration side. Are you Canadian citizens?

1. Under 18 and orphans they can be sponsored without too much trouble. They don't have to be adopted.

Thanks for the advice.

I read through some of the stuff on the link. It would be dependnt on us fulfilling the criteria for both countries adoption policy. Seems like it might take a long time and the kids couldn't live with us here until it was all finalised. Don't know what would happen in the meantime with them......lots to think about.

no problem about jumping on the thread. Its a weird subject and not one we thbought about through the whole imigration thing. But our friends are updating their will and need to know if we can still be includd as their children's guardiens.

Once again, take some professional advice in writing from a family law practitioner in your province.

no, we are not canadian ciitizens yet, we can apply in another couple of years or so.

The agreement we have is to cover until they are 18, so we could use the sponsorship route for this should the need ever arose. Thanks
