Default Adding spouse to an ongoing application-please help !!!!

Dear experts

I have some queries which I hope you all can help me with.

My application status is
Applied for Imm under skilled category - Nov 2001 at Buffalo
AOR received Jan 2002
Interview waiver and medical instructions received 25th Nov 2002

some extra documents are requested and its mentioned NOT TO COMPLETE medicals until 6 months from the date of the letter.
1. Does this mean that the background/security checks have started ?? or will they start after my medicals and other documents are received by them ??

2. I am having my registered/civil marriage done next week and I would like to know what is the next step I should be taking.
Having informed them of my status, I want to add my husband to my file but i wonder what will its consequences be at this phase of my application process.
What can be the tentative amount of delay to my process ?

3. From where will I be able to get the forms needed for addition of spouse to application? Can you please tell me the location ?

I would really appreciate your inputs and suggestions and I hope someone can guide me in the right direction.

1. It doesn't mean that - it may be already under way or may be requested
any day now.

2. You have no choice - if you change your marital status **you must**
notify visa post and add your spouse to the application. If you won't do it
and visa is granted to you as a single while already married then it will be
invalid. Notify Buffalo about the marriage immediately after the fact and
follow instructions from them - you will have to submit your marriage
certificate, spouse's application, photos, copy of passport, all required
documents and application fee.

3. Download them from CIC website.

Dear Mr.Miller or Other Experts,

I have similiar situation, however, it might be a little complicated.
Given the lenghty time of application process, I am sure there are many
other applicants who share the similar situation such as marriage and having babies during the application process.

First, here is my detail application status:

Application filed to Buffalo office under skilled category
and single status: Nov 2001
AOR/file number: Jan 2002
Initial Assesment: Dec 2002, interview waiver, and medical forms.
advised to do medical after 6 months, requesting additional docs
such as FBI, police certs, and bank statement/funds to be transferred

I filed the application while I was still in California and H1B holder and single status. I left US after filing the application.

In Sep 2002, I got married with my fiance (same nationality as me), and she is now pregnant. We are expecting our first baby sometime next year in August/Sept 2003.
FYI, my wife holds an Bachelor and MBA degree from US colleges but no real significant work experience.

Questions:
1. I understand from your reply to robi63 that I will have to immediately notify the Buffalo office and furnish additional documents for my wife.
In order to avoid delay in processing my case, can I just wait until I get my final approval, land officially in Canada as PR, and then sponsor my wife? In term of length of time, which one is faster? Notify the Buffalo now or sponsor her after i get my PR? How much delay are we looking at?

2. Since I filed as a single, in the recent assesment letter, they sent medical form for me only. To speed up the process, I have already prepared the paper works for my spouse to send to Buffalo notifying them to include my spouse. Understand that me and the spouse must be examined by the SAME designated medical practioner.
The question is, since I have been asked to do medicals in 6 months, to speed up the process can I also take my wife to do medical checks together OR wait until Buffalo send additional instruction for the newly-included spouse and additional medical form for my wife?
IF it is OK to take my wife to go ahead with medical checks with me, where can I get the additional medical form for her?. I don't think the medical form is avail in CIC website, isn't it? Can I request it from Canadian High Commission in Singapore?

3. Currently, we don't have any children yet, but she is currently pregnant and will expect our first baby in August/Sept 2003. What should I inform the Buffalo office? I understand each medical checks is required for EACH dependent.

4. As mentioned in the assesment letter, the interview is not required at this moment. What is the chance for the officer to change his/her mind after including my wife as a spouse assuming my spouse is completely clean in term or health and security, master degree and US educated?

5. If for some reason, the interview is required, the interview most likely will be in US. I am concerned that I might be having difficutly getting US visa since I come from home country which require additional security check, at least taking couple months.
It is possible to have the interview conducted in Singapore? I know that Canada High Commission in Singapore is in-charge of immigration matter for Southeast Asia.

6. Finally, not really related to this subject. I have been living in Singapore after leaving US. At the time of filing I was never in Singapore that's why I didn't submit police certificate from here. Should I now submit the police cert from Singapore since I have been living more than 6 months here AFTER filing the application in Nov 2001?

You got married in September and you should have immediately notify Buffalo
about the fact and add your wife's application to your case. There is no
option to land first and then sponsor wife - your visa will be invalid if
issued to you as a single while in fact you are married, so don't even think
about it.

Send everything to Buffalo ASAP and you'll get medical forms for your wife
in proper time. More - because she is pregnant medicals will have to be
delayed anyway until baby is born as your wife cannot have X-Rays done. Then
you will also have to add baby to the case.

It is rather unlikely to be called for selection interview after initial
waiver, although there is no guarantee and it happens in some cases.

Interview must be conducted by visa post processing the application (or it's
satellite consulate). You cannot have interview in Singapore.

By the time baby is born and you all will do your medicals you'll be in
Singapore for longer than a year and for sure you'll be asked for updated
police certificates, so obtain them just before submitting baby's documents.

Thank you so much for the information. It is really useful to have this info. One more question though. For clear, I am adding my wife info
into the application. However, what is the procedure of notifying Buffalo
that we are expecting a baby in Aug/Sep 2003 as additional dependent?
Certainly, at this moment there is no way I could provide the information for this incoming dependent such as name, dob, sex, picture etc. Has there been this kind of case before? In you experience, what is the most likely action from the Buffalo consulate at this stage?
Given the current status of my application, if everything goes smoothly, when do u think the earliest time to have the final approval? Dec 2003 or early 2004?

Just inform Buffalo when adding your spouse that she is pregnant, provide
expected time of delivery and tell that as soon as baby is born you'll
provide all required documents to add baby to the case. You wrote that your
baby will be born in August/September - then don't count on having visas
before the and of 2003.

Foremost, thanks for all the advice Mr. Miller

Few questions though..

1. I had my registered marriage on Dec 2nd 2002 as a proxy one.. I had given a power of attorney to my father to sign for me. The reason for my absence was due to US visa problems. The marriage is completely valid and legal and accepted in that country, and I know of many similar cases that have been accepted by Canada too. Should I give an explaination to the consulate for this kind of marriage when I submit my husband's application or should I wait till they ask me for it specifically??

2. My husband's application and documents will be ready for submission at the end of January 2003. Thats when they will be informed of my marital status too. So can I submit all marraige papers at that time OR Should I send a fax now and let them know about my marriage and tell them that I sending all his papers later ?? Is this 2 months wait harmful ?? (Since you always insist that they should be notified IMMEDIATELY !!! )
What do U suggest I should do ??



3. Can you please confirm if the forms my husband needs to fill are
1 IMM0008 Schedule 1 (background declaration)
2. IMM5406E Family information
3. Pay Processing Fees
4. All documents required.
Anything else ????
Do I need to fill any forms or provide any extra documentation??
