Hi,
Friends of mine have been advised that they can leasehold a property in Goa via the UK on a "99 year lease"( Paperwork arranged in Goa and stamped by the High Court there)
Any advice from anyone out there regarding the validity/legality of this type of arrangement even allowing for the current situation ?

It is the consolidated document which includes FEMA and all Notifications and Orders issued by the RBI (re. FEMA). They usually issue the final version in July each year.
From a quick look it doesn't seem to be any different from last year as regards immovable property.

Does this mean that the 1999 FEMA regulations still apply ?
This document,seems to imply that the only a means foreigner can hold immoveable property is by inheritance ?
No mention of any other avenue save the business route,which unless you are running a legitimate business is liable to be exposed and penalised.
If so are presumably we are still OK if we have gone down,or indeed still go down the 183 day, in one financial year,residency route?
Hopefully once the dust clears we shall be able to register property again if
we have acted within the law.
Sorry to try and use you like a Barrister,but you are good at it .

The British Governments Foreign & Commonwealth Office has this warning posted on their website regarding travelling to Goa.
Goa
The Government of Goa has strict rules governing the purchase of property in the state by non-Indian nationals. If the purchase is judge to violate local laws (including if you purchase whilst on a tourist visa), you are likely to lose all the money you have put into the purchase and may even face prosecution.
