Hi,
in http://www.goanvoice.org.uk today, there are two articles of interest.
one Churchill on video saying he will oppose the decision against FN.
and another in the photo gallery - D. of E issues notices for foreigners where varna vikram will give you a free assessment of your case!

It is the consolidated document which includes FEMA and all Notifications and Orders issued by the RBI (re. FEMA). They usually issue the final version in July each year.
From a quick look it doesn't seem to be any different from last year as regards immovable property.

Hi,
Friends of mine have been advised that they can leasehold a property in Goa via the UK on a "99 year lease"( Paperwork arranged in Goa and stamped by the High Court there)
Any advice from anyone out there regarding the validity/legality of this type of arrangement even allowing for the current situation ?

Thank you.

Does this mean that the 1999 FEMA regulations still apply ?
This document, seems to imply that the only a means foreigner can hold immoveable property is by inheritance ?
No mention of any other avenue save the business route, which unless you are running a legitimate business is liable to be exposed and penalised.
If so are presumably we are still OK if we have gone down,or indeed still go down the 183 day, in one financial year, residency route?
Hopefully once the dust clears we shall be able to register property again if
we have acted within the law.
Sorry to try and use you like a Barrister, but you are good at it .

Yours forever confused: confused:

Yes the Act still applies, this just consolidates related rules & regs.
This document, seems to imply that the only a means foreigner can hold immoveable property is by inheritance ?
"Foreign nationals of non-Indian origin resident outside India are not permitted to acquire any immovable property in India unless such property is acquired by way of inheritance from a person who was resident in India."
An avenue that afaik no-one has explored yet!
If so are presumably we are still OK if we have gone down,or indeed still go down the 183 day, in one financial year, residency route?
If you also meet the 'intention to stay' criteria then in theory you should be OK
Hopefully once the dust clears we shall be able to register property again if we have acted within the law.
we'll have to wait for a High Court decision on that!
Sorry to try and use you like a Barrister, but you are good at it .
OK that'll be Rs. 500/- for the back pocket please <bg>.

Hi All,

The British Governments Foreign & Commonwealth Office has this warning posted on their website regarding travelling to Goa.

Goa

The Government of Goa has strict rules governing the purchase of property in the state by non-Indian nationals. If the purchase is judge to violate local laws (including if you purchase whilst on a tourist visa), you are likely to lose all the money you have put into the purchase and may even face prosecution.

From Goan Voice UK - Excerpts:

Guardian Feature article - issue of 26 June 2008
Property clampdown is new cloud on horizon for Britons living Goan dream: Foreign homeowners without proper sale deeds may lose everything

26 Jun: The Guardian (UK). Foreign homeowners without proper sale deeds may lose everything…
the property clampdown and tightening of visa rules mean many are leaving for good…Goa has an estimated 3,000 long-term foreign residents…
Dayanand Narvekar, Goa's law minister, acknowledges that 99% of cases involving the British are simple purchases of apartments and says, “I personally feel we should take a sympathetic view and not touch these properties.”…
The panic has forced the British high commission to act…
Goa's British residents also feel that getting or renewing an Indian visa has become much more difficult…
There's a definite feeling in the expat community now that Goa has had its day…
