Hi Annabella and welcome.

All I can say is let Karlq come back to us when his friends are investigated as we have nothing to hide - all they can get any of us on is "intention to stay" and they can twist that anyway to suit themselves. Nobody could have done it "more correctly" - but then we did not know the :curse::curse::curse:

Please answer this silly question. Given the amount of available property in Goa and the selling to non-Indian restrictions, it must be pretty easy to rent at a reasonable price. So, given all that, why don't you all rent property instead of going the risky route of buying? Were you all treating purchase as an investment? I had been interested in visiting Goa and having a look at property to purchase but am now deterred.

Hi Annabella,

Not a silly question at all - but some of us are trapped into a situation which years ago we did not know about. This is why we are trying to inform others
not to follow down our route and rent.

For what it is worth - at least we have our Deeds Registered, the Acron people I worry about as theirs is on a lease, and as you can see from a letter from the RBI you can only lease for 5 years. Will they allow them to lease for a further 5 years? or will the Government move the goal posts again.
It is all very worrying.

We had been going to Goa since the early 90's and loved the place, two holidays a year. Then in 2000 we signed a Sale Agreement for our Apartment and acquired the final deeds Registered in 2005, after doing the 182 days in the previous financial year. At that point in time there was nothing being said about not being able to purchase. We had as it was then, done everything by the book. Right 5 year x visa, monies transferred via banking system, 182 days + etc. etc. and then this January we were hand delivered a letter from the Directorate of Enforcement asking so many questions, we all had to instructed an Advocate. and cost £100. page 11 thread 301.

Everything you see in this letter from the D of E had to be done in triplicate with three files made out by ourselves, the running around, photocopies, having deeds authenticated took days passports in triplicate every page, pink residency book every page even the blank ones - well you know how it is out there.

This was in January, and we were given 15 days to do this. Our Advocate has told us that the D of E has started from Registration 2005 (last time anybody FN could register) and they are working back through everybodies files.

We contact our Advocate a few weeks ago, and he says the only thing he has received from the D of E is acknowledgement of our files.
I don't honestly believe if they clear us, they will give us the courtesy of a clearance letter. Anyway God help the others who have done it with the wrong visa's or via the false company route.

I am looking forward to going back in November and enjoying the sun, sea and the 'noffi and meeting up with all my "invisible friends"

This property was bought for my children and grandchild to enjoy after my days, the Goa which we loved, not as an investment to make money.

If i may add my tuppence worth here,

Most FNs buy property there not as an investment but as a retirement/holiday home. Pre-August 2006 this wasnt a problem and 5 year x-visas were ready available. Many FNs like Noni and Douglas bought and registered their properties and obtained title deeds.

Post Aug 2006, the rules became far more stringent because of the Russian Mafia landgrabbing all over Goa.
5 year x visas are no more and the rules on property and land purchase have been really tightened. It use to be, that to become resident all you needed to do was complete 183 days in a fiscal year now they are insisting that you prove 'intention to stay' ie. work etc and doing the 183 days is no longer enough. They dont want retirees apparently and they are insisting that retirees should spend their retirement in their Home Countries.

If FNs who had bought Pre Aug 06 had forseen the change then they probably would not have purchased in Goa but went elsewhere or like you suggested rent instead.

Any FNs that buy there now(post aug 06) are IMHO not making a good decision. Also Goa is not the place to invest in as you cannot repatriate capital gains.

For investing look at Malaysia, Cape Verde or parts of Eastern Europe but not Goa. Most people that have bought there have done so because they like the culture and the way of life but not as an investment.
It is a real case of 'Buyer Beware' and 'you pays your money and takes your chances.'

Thanks to you too Remy. All is now clear. "They" have moved the goal posts. What a big disappointment. No, not looking for investment at all. Too much trouble at my age. Have family in Bangalore and Goa seemed a good place to be from time to time. Have heard so much about it and visualised myself flitting along the beach in something unsuitable for my age with a flower behind an ear. (The one without the hearing aid!) (I had heard there are a lot of now old "hippies" who have stayed on there since the 70s). Ownership is great but it is still an obligation.

Are you of Indian Origin by any chance?
If you are then buying in Goa will be easy for you.

Yes, you do come across some old hippies who have stayed in Goa (illegally) since the seventies. When i was at Palolem in the early 90s there were some old timers living in the caves there like neanderthals,(pretty cool). The air was pretty heavy with marijuana at times too.:eek:

No, don't think I am Indian. Just looked at myself in the old mirror and I look too white to be anything else but Caucasian. Old-timers and living in caves? Now that sounds just up my street. I look better in the dark.
