Letter received today from the Dept of E says :-
Sir. Enquires under the provisions of FEMA 1999 reg This directorate is conducting certain enquiries under the provisions of FEMA 1999 in respect of immovable property purchased by you in India. In this connection you are required to furnish the following information/ documents. 1 details of immovable properties purchased along with the copies of sale deeds and source of funds. 2.total period of your stay in India during the period 2004-2005 financial year wise along with copies of your passports. 3.Details of visa issued along with copies thereof. 4. Details of your bank account transcriptsertaining to the period from 2003-2006 5. Copies of residential permits issued to you to reside in India from time to time 6. Purpose of stay in India 7. This letter is issued under section 37 of FEMA 1999 Signed Girish D Lotlikar. All this information was furnished in 2007 when the original enquiries were requested. There is no date applied to the letter for replies by. As we have no plans to return to Goa before the end of October,what do you suggest is the way to proceed. Slagtip |

Slagtip Then my suggestion would be to reply to Mr. Lotlikar by International Signed-For letter referring him to your previous reply (with dates etc.) and informing him when you will be in Goa. 2) Get all the documents ready again! 3) Do try for the X visas. Thank you,we were disappointed after all this time to be asked for the same information we provided so long ago,all he asked about seems ok,the only one is providing bank statements from 2003.luckely we retained our old passports.

Recognize any orchard/cultivable plots rezoned as final for settlement/commercial in your vaddo?
Time to check your survey plot is correctly zoned and appropriate sanad has been registered. Otherwise, apply for land conversion now and make a valid case for why the sanad was never registered, just like the vast majority of survey plots in Goa which have had houses on them for decades and show only as cultivable land, non settlement. Inability to provide land conversion sanad has been one of the D of E's past strategies towards threatening confiscation and penalty. |

Govt appoints panel for land deals under FEMA Murari Shetye, TNN | Aug 22, 2013, 02.28 PM IST PANAJI: After allegations of violations of Foreign Exchange Management Act (FEMA) during the purchase of land in Goa by foreigners, the state government has notified a committee to scrutinize all land deals by the foreigners. The committee is constituted for the state of Goa to process the pending and future applications of foreign nationals or India nationals regarding the purchase of property or sale of property by foreigners, Person of Indian Origin (PIO), Overseas Citizens of India (OCI) etc The committee would be chaired by joint secretary debt management unit, government of Goa while member secretary would be state registrar-cum-head of Notary services and members are officials of Reserve Bank of India, under secretary revenue and debt management unit and deputy collector North and South Goa. Enforcement Directorate (ED), Goa had already issued notices to British, Russian, German and Italian nationals for violations of the FEMA relating to purchase of immovable properties in Goa. Is it too optimistic to hope they might look favourably at the complexities of how an extremely small number of foreigners relative to the entire population of Goa got themselves into the situation of buying property on best available advice given at the time that their actions were legal, and parted with their money in good faith? That is, before the previous administration's late in the day hostile interpretation of the ambiguous use of English in the wording and meaning of FEMA combined with a general anti foreigner sentiment. Let's hope this is a step forward in resolving what is truly a minor issue in the total governance of Goa, but a source of great anxiety, uncertainty and bitterness to those non Indian property owners (mainly Brits) who have felt severely persecuted for at least 8 years now. Can this not be put to rest fairly and finally now in an acceptable and amicable manner for all concerned? |

Babu, this was first reported in June 2012. The British High Commission amongst others have been trying to find out the details and legal basis of this committee with afaik no success to date.
