Have been asked to put this on BE - please will you give your version.
1. Has anyone who has registered a company been served a default notice on that company?

2. Has anyone paid a lawyer to register a company and found that the lawyer has failed to submit necessary documents?

3. Has anyone paid monies to a Goan lawyer IN their British bank account and then had problems with properties afterwards?

4. Has anyone purchasing a property in Goa been given wrong information by a Goan lawyer?

5. Has anyone had other problems with Goan property due to lawyers actions?

If so please give us details.

Heard from people that their North Goan Advocate has got her into real trouble she is being fined by the Ministry of Corporate Affairs 2 x 50,000 rupees because of bad advice re the company they set up.
Approximately three months ago they received a 'default notice' for the company regarding no accounts being submitted and the failure to submit forms for the RBI certificate. This was from the Ministry of Corporate Affairs. They are now under threat of fines of 2 x 50,000 rupees for the lack of RBI cert,and it is costing her in excess of £1200 to get the legal matters with this company sorted out.


What is the Ministry of Corporate Affairs - Andy, J5 - where do they come into it.

We were advised NOT to go down the Business Route, by both Developer and Advocate, as holiday lettings were an 'iffy' avenue.

But seeing those who registered with 5 year x are under investigation I don't see much difference - which do you think was the best advice :rofl::rofl:

The Ministry of Corporate affairs is ehp you submit your company accounts to every year,It's who you set up your business and apply to.They can fine you heavily for not submitting your files.It costs an arm and leg yearly to do this:thumbdown:

Hi Noni,

Surely if anyone is going down the business route.....they are wise enough to employ the services of an accountant immediately. An accountant takes care of tax returns, filing accounts and RBI documentation.
I would never start a business anywhere in the world before registering with an accountant and have an advisory interview first. A good Accountant is worth their wait in gold and usually turns out to be a very good investment.
I would'nt rely on an Advocate who is probably out of his depth.

I had an accountant recommended by a businessman I knew from Goa. I paid him a good yearly fee and he got me my directors digital signature sorted and my PAN card,(tax card I think this is)
Anyway all well I thought. On my visit this year he tells me the last two yars accounts have been sent back or refused as they were incorrect. Something about the inward remittance certificate not matching the company assetts, ie the cost of the flat we purchased. Big problem was these accounts were 05/06 and 06/07 and he only submitted them in Jan this year even though they were signed of by me and my partner and I had copies etc.

Needless to say I was livid. That was when we just went ahead and got rid of the flat. Problem I now have is if I return to Goa. Will I be stopped at the airport and arrested as the company has submitted no accounts etc even though I paid everything to an accountant including any tax due.It was only a few quid but thats not the issue is it.

So I am now doubtfull of going back to Goa for a holiday to see my friends.

How on earth can any of us find a good solicitor or accountant in Goa. easier to pick the lottery numbers.

Sound advice Remy, its very advisable given the complexities we face to employ a professionally qualified Chartered Accountant rather than a general
Accountant. (Most will display their professional qualifications certificate in their offices).

Frustrating as it can be, we all need to accept that India simply doesnt function in the same way as the UK - leave written instructions regarding account submission and do a follow up to check if necessary.

Hindsight being the wonderful thing it is !
Lets face it, we have all taken the advice of the lawyers to the letter - and the advice they are giving is blatantly wrong. I know Im the not the only one told to hold fire until I had the RBI cert.

Lawyers, liars? Intonation conveys the truth. Has anyone been to the Bombay High Court building? They stand around like ticket touts at a Mick Jagger concert...starched up n in dust covered shoes reeking of curry and cheap cigarettes. Does a single one of these LLB louts know the law?. Heck, does the PM of India know what's going on? Might as well buy a bag of local "basmati" rice from a starving somali. The Goan lawyers are a more sophisticated brand with the wherewithal of office space and staff and connections of a personal nature. Most importantly, they have funds to carry the charade- all provided by FNs.
