Help: Notice when quitting an apartment for work.
 

Hi, I live near Bordeaux and have found a job near Toulouse - closer to my kids.

I leave my current job on Friday and start my new one on the following Tuesday.

I sent my letter with AR to the estate agents with a months notice but they say this only applies if I am transferred within my company and not taking up a new post!

Does anyone have knowledge of the current state of the law??

I'm lost and facing a bill of 2 months rent for nothing.:blink:

Hi,
OH says that you took the initiative to move to another town, and that the Immo might be in its right to make you pay the two months' rent. You presumably paid one month's deposit (caution) and there's no Guarantor involved?
Have a good look at what you signed in the Bail (Lease Agreement), but OH suspects you'll have to pay, as Leases normally specify prior notice of 3 months.

Just noted this:
Cas général: Delai preavis = 3 mois
Condition: Le départ n'a pas à être motivé.
(Was your move motivated by family circumstances? If so imho this 3 months may not apply.)

Mutation professionnelle: Delai preavis = 1 mois
Condition: La date de la mutation doit être proche de la délivrance du congé (plusieurs mois ne doivent pas s'écouler).
Elle peut être à l'initiative du salarié ou de l'employeur et n'est soumise à aucune condition d'éloignement géographique.
Exception: Un préavis de 3 mois s'applique aux locataires exerçant une activité libérale.

The way I read this you are within your rights of 1 months notice, unless you are an entrepreneur.

Thanks you 2 for the responses - the way I read it - I'm screwed.

Mutation professionnelle: Delai preavis = 1 mois - if I am transferred -I read this as being still in the same company but at another site. My new job is a separate company.

I do see an option though - IF I GET FIRED BEFORE NEXT FRIDAY!
