Flood damaged tools - who pays, if anyone?

Default Flood damaged tools - who pays, if anyone?

Hi guys, I know there are many many thousands of people worse off than me right now due to the floods in Queensland.

My situation is this.

Working for an employment agency at a local factory, some of my own personal tools have been destroyed. Am i legally entitled to get these replaced, and if so, who by?

I didn't personally have them insured but i wondered if they would be covered by being on the company's premises when the floods came.

Quick answer is they really should not have been taken in to the factory - if tools to do the job are required they should be provided by the employer.

BUT, personally I would be asking the boss, not an internet forum

No, in my experience I don't think you would be covered by the company but I may be wrong.

I'm sure the factory will be covered on insurance mate. Ask the boss and I'm sure he'll help out where he can

In my previous life, when subbies tools got stolen from buidling sites, generally the building company paid up via insurance.

Don't know but I'll tell the husband in the morning to find out what would happen about his if his place gets robbed or flooded. Not thought about it before so thanks Jazz.

Generally they are insured while you are at work but if they are left unattended then no they are not insured. I guess it would depend on the insurance policy but there are a lot of insurance policies that don't cover floods raising from a river only flash flooding or storm surges.

When we're finally able to get back into the factory, thats exactly what i'll be doing. Until then i thought i'd try and find out the legal aspect, if thats ok with you of course

My guess would be ..... if they're not prepared to pay out on the correct type of water for house damage tools would be the last thing on their priority list
