P85 and employment

Default P85 and employment

Hello,

New poster here hope someone can help. I moved out to Belgium on a contract in May 2008 (just after the tax year) and have just found out that the contract will end at the end of Jan 2009.

There is a possibility that the contract will restart later in the year (May/June 2009). I have the resources to stay out of the UK until after Apr 2010 (a full tax year) without working. I'm thinking of Spain for a few months for a holiday/break.

On reading the P85/P86 forms it seems employment is as important as being out of the country for the full tax year. Is it that important ?

I am just getting round to completing the P85 (due to a problem with overpayment from my last UK employer) and now I know I'm not going to be in full time employment wonder how (or whether) I should complete the form at all.

Any advise anyone ?

Reading about it on HERE it looks like you should of filled it out long ago so that you don`t get a tax bill from the UK for last year.

I couldn't. I had an incorrect P45, I was overpaid by my last UK employer and it took 7 months to sort out the repayment and the correct TAX/NI figures. I was advised by HMRC to wait until the correct figures were available.
