Hi guys,

So I'm an Irish and Australian citizen. I've been residing in Australia for the last 6 years and will likely be convicted of a drug offence in the coming months.

I was just wondering if my criminal record will follow me back to Europe if I move there as getting a job will be impossible now in Australia.

With an Irish passport there is no problem moving to Europe. It's up to the employer you apply to, and the particular job as to whether they require an Australian police record or you need to declare the conviction. A drug conviction on it's own should not stop you getting back into Europe on your IRISH passport. Brit in Paris may come along - he's our expert in these matters - with a more definitive answer.

Depending on the country there should be no issue as long as you are honest and the comapny doesn't have a problem. Ireland is actually very good in that sense and gives people options.

A lot will depend on the severity of the conviction and punishment.

Do you think it's likely that an employer in Europe would do an Australian background check if I was coming into the country from Ireland with no signs of residing in Australia in the past?

It's a drug offence "intent to supply" - I think i will get 12months max in prison.

I guess the real question is, will ireland or europe know about my offence in Australia when I come back to Ireland.

I mean, I was born in Ireland and lived there for 14 years, it's not like I'm applying for a visa or anything

The Australian police MAY pass the details of the conviction on to the Irish police, in which case they would appear on a police check done in Ireland. There is no way of knowing whether the details will be passed across p some are, some aren't. As its a drugs offence I would say that makes the chances higher.

Depends on the employer but with all information in computers police checks get all data instantly + it's easy enough for anyone to google you and get information in seconds.


Being honest about it will only help, as that proves you learned from mistakes.

Seeing as though he is still waiting for his court appearance and says he is likely to get a prison sentence, then I suspect it will be difficult to prove he has learned from 'his mistake'
