Hi,

I have a question from my friend as follows:
A Hong Kong passport holder wife and BNO passport holder husband, the husband lead to apply for BNO visa with his wife, both arrived Uk, but the wife wants to divorce.

the question is: after the divorce, the husband back to Hong Kong, and the wife still can live in the UK for 5 years and then apply for ILR ?

If they separate then the wife will need to inform the Home Office and her dependant visa will be cancelled.

If they don't divorce, how about the husband back to Hong Kong and only the wife stay in the UK for 5 years applying for the ILR ?

That would be separation, the link given above covers that as well (as does BiP's response).
