Hi,

Just read this thread from top to bottom - so much useful information here. Thanks to all the contributors.

I would like some clarification around my scenario, which is as follows:

My wife's FLR(M) spouse visa began in July 2020 (I am a Britizen citizen from birth). Our expectations are to complete the 2x 30 month periods and then apply for ILR (and subsequently Citizenship) in June 2025.

Our understanding is as follows:
  • There are no specific absence rules for FLR(M) however we should not exceed 180 days of absence during any 12 month period.
  • To apply for ILR on the 5-year route, we must not exceed 180 days of absence during any 12 month period.
  • Assuming we applied to Citizenship immediately after obtaining ILR, we would need to ensure we've been outside the UK for no more than 450 days total over the 60 months. as well no more than 90 days in the 12-months prior to the ILR/Citizenship application being made.
Please can somebody confirm the above 3 statements are correct?

These are the rules for naturalisation for someone married to a British citizen:

To satisfy the residence requirement you should not have been absent for more than 90 days in the last 12 months. If you are married to or in a civil partnership with a British citizen, the total number of days absence for the whole 3-year period should not exceed 270.Dec 31, 2020


There are no hard and fast rules for FLR(M) or applying for ILR, but constant and lengthy absences will be taken into consideration as to whether the applicant is living up to the spirit of the visa i.e living with partner on a permanent basis in the UK.
