Yes, a pretty substantial fee to pay at each stage! You're lucky you can apply for ILR under the old rules, which were quite reasonable.

It is probably the only governement department that makes a profit.
It would seem so... Visas are expensive & rising every year, yet UKBA still fumble way too many applications. Idollard posted this story yesterday in a thread of its own here:

Bear in mind this is the internal UKBA guidance which gives an insight into how they interpret the rules. How would an ''ordinary'' individual be able to ask a judge? We Couldn't afford to consult a solicitor - (even if you could find one, who knows the regulations) - We have just consulted the C.A.B. - who the UK Border Agency suggest, that people get to check all documents before submitting them for application, and they were talking ''duff gen'' to us!!!

Hi Vexcore-

If you get ILR, you then have to qualify for a 5 year 'in the country' period..
HOWEVER>>>>>>Hate to throw a spanner in the works, but also be aware, that as many countries outside of the EEA do not recognise Dual Citizenship, getting a UK Citizenship , via a Passport, might not be a very good idea, if the party from overseas is likely (as my Thai wife is) to inherit land and /or property in their birth country, you could be barred from owning it, and classed as a 'Visitor' by that country of birth.

That circumstance is listed on the UK BA Web Site, regarding Citizenship......

The same way we did. Apply, get rejected, appeal, wait nearly a year for something you should have got within a few weeks. So if you can follow the internal guidance and the ECO does the same (which they didn't in our case!) life is a lot easier.

We did consult a solicitor a couple of times - from a company which according to the relevant legal rankings books was meant to be a top 10 for immigration. We got terrible and incorrect advice. Not worth it in my opinion.

I may be stupid - but I didn't know you could consult with a judge, without going through a legal procedure, and paying large sums of money for the priviledge. Pop round his mansion, maybe?

Should ask - are you in the UK? Or can we still get legal aid?

Nope - we didn't have any back-door access. We went through the legal procedure of an appeal

Lots of people are appealing their refusals under the new rules. The 'Family Visas' section of Immigrationboards.com forum is full of posts about appealing a refused spouse visa. The entry clearance officers who handle the visa applications are human & they make mistakes. So if you think you were unfairly turned down, you can appeal. Some handle this themselves & others consult a professional.

It's not supposed to cost "large sums of money", but that may depend on each case's complexity & how confident you feel in fighting your corner. The more research you can do yourself, the less you may need to pay a professional immigration advisor.

'Spouse visa' surely is for Someone coming here to marry their UK fiancee? Why were we told the surest course for us, aT the British Embassy in Bangkok ( where we married) would be via a ''Settlement Visa'' - which I don't think carries the appeal situation? (i may be wrong - hope not, as we have just done the ILR @ £990!)

No Don, a spouse visa is one of several types of family settlement visa. The other kinds are unmarried partner, child dependent, etc. These are all settlement visas. (Maybe you're thinking of the Fiance(e) or proposed civil partner visa? the Fiance(e)/PCP visa is not a settlement visa per se, since it only lasts 6 months and must be exchanged for a settlement spouse visa once the wedding has taken place in the UK ....)

If the spouse visa applied for outside the UK is refused, the applicant has full right of appeal if he/she thinks a mistake has been made. If the spouse visa is applied for inside the UK and is refused, there is still perhaps a right to appeal. Did you apply from within the UK?
