UK family visa application from within UK
Hi, Apologies for the length of this post, I've tried to include all the relevant information.
I am a British citizen and my husband is Australian. We've been living in England with our two dual-nationality children for the last 4 months. My husband entered the UK on his Australian passport, which obviously gives you six months of time here. We aren't working here so no issues with that. He has an ongoing application for a European citizenship, and we expected that this would be successful by now, which would then give him ongoing residency rights. This is why we didn't apply for a proper British visa before leaving Australia (where we were for many years beforehand).
So now we are in the UK, and he only has about ten weeks left of that initial six months from entering on an Australian passport. We can't be sure that the other citizenship will come through inside that timeline, so he needs to apply for a Family Visa. We are confident that we meet the criteria, but unsure about the application process - we are already living in the UK, can he apply from here? If not, does he have to apply from Australia or can we go on holiday and apply from overseas? And in either scenario, can anyone advise how long we might need to be without our passports?

You cannot apply for a visa from within the UK, nor from a foreign country where you don't have right of residence. From what you have stated the only country that meets all the requirements is Australia.

Thanks for that. Is it as simple as flying back to the submit theme application, or then having to remain there until it's approved? (can you pay extra for it to be expedited?)
And, not that I'm suggesting we will do this, but it looks like the application is online anyway - what's to stop people using a VPN and applying from anywhere?
Edit: looks like you have to give biometric info in home country. So aside from that, it doesn't matter where you are?

Yes you can pay for priority service. The biometrics are done in the home country and passport will be returned to address in home country. Only then does applicant enter the UK to pick up their BRP document.
You, the Brit sponsor, only has to provide a copy of their passport. The applicant sends his original passport with the application - so could be 12 weeks or more or less if priority.

You’ll need to submit biometrics and hand over your passport. Apply from any country in which you are not a citizen or legal resident and the application will be refused.
Which EU citizenship are we talking about? Italian? Greek?
