Tourist Visa for non Eu spouse
Hello,
I've been looking around the forum for ages but can't seem to find my case. Sorry if this has already been asked.
I have dual citizenship (UK and Belgium) and am married to a Moroccan. We got married in Spain (I used my Belgian passport) and are currently still living there. He got the EU spouse documents.
My parents are both British and live in England. We would like to go and visit them (just one week).
My question is: does my husband need a visa to enter England? Or is being the husband of a British citizen enough?

Ordinarily yes, as a Moroccan citizen, he would need a visa.
However if you have been living and working in Spain and therefore exercising your treaty rights as an EEA citizen, then even though you are a British citizen, your husband could be eligible for an EEA Family Permit under the Surinder Singh ruling. These are free compared to 105 Euros for a visitor visa.

I've just written a similar question on another thread:
UK citizen married to colombian, living in spain (she has spanish residency but not nationality). We want to visit (not move to) my family in the uk.
I've been looking at the family permit but the gov.uk website says:
* the person you’ll be accompanying or joining is from the European Economic Area (EEA) but not the UK
* you’re from outside the EEA
Does she have to comply with both or just one of these?
Does surinder singh apply to those wanting to visit rather than move to the uk?
