I was granted a spouse visa on 26 July 2019. I entered the UK on 31 July 2019. I'm on a spouse visa which is up for renewal on 26 April 2022. (which would be 33 months).

I intend to switch into the BNO visa scheme for the other 2.5 years.

Does the 28 day rule before the 30th month 'anniversary' apply if I switch into this visa or do I have to wait until I reach 30 months and then submit an application?

The 28 day rule applies but I would wait until April before applying for your BN(O) visa so there’s no danger of running short of time.

Thanks. Why do you think there would be any danger in applying early? I applied for my spouse visa outside the UK, so 33 months, was granted the visa on 26 July 2019, and entered on 31 July 2019.

Expiry is on 26 April 2022. However if we count from the date of entry, for 30 months it would be 31 January 2022, minus 28 days, which is 3 January 2022.

BNO visa clearly states an application is either 30 months or 5 years. I thought as long as I have completed 30 months on the spouse visa, then another 30 months on BNO it will complete the 5 year requirement?
