spouse visa for Dutch wife
 
hello.
I am reading a lot about how British citizens are having trouble moving back to the UK with a non-uk spouse. Im British and I still have a British passport. My wife is Dutch and we have 2 kids. Would we have restrictions moving to the UK? Would I need to earn 25,000 in the UK before we can apply for the spouse visa, or is that for non-EU spouses? What other restrictions might we have? And is it possible restrictions could change soon?

She is an EU citizen and, as the UK is still in the EU she can move here with no restrictions. you do not need to apply for a spouse visa, she would just be exercising her rights as an EU citizen. No=one knows what might/will happen after Brexit.

ok. thanks. I couldnt find anywhere whether a spouse visa was for EU citizens or not.

But I guess if/when Brexit kicks in I may need to earn that kind of money to keep my family from being deported... like you said, who knows.

Spouse visa is for non EU citizens.

I understand, thanks. I just meant that after Brexit spouse visa may potentially be for EU citizens as well.

If your family is not in the UK then your wife cannot be deported. If you are outside the UK and you decide to return after Brexit then you will have to comply with whatever rules are put in place for EU citizens. It's possible that your wife will be subject to the same rules as non-EU spouses but nothing HMG has said so far would make me believe that to be the case.

Is this purely an intellectual exercise or do you have plans to move back in the near future?
