Spouse Visa Denied need help
 
I applied to join my wife but it seems we used the wrong application form which was for settlement. She is under tier 2 of the points based system until 03/02/2020. Refusal letter stated that :

You have applied to join your spouse in the UK. However your sponsor is currently in the UK with temporary leave under tier 2 of points based system until 3/02/2020. Therefore your sponsor is not a British citizen,is not considered present and settled in the UK and does not have refugee or humanitarian protection status. Your application therefore doesn’t meet the requirements of paragraphs E-ECP 2.1 of appendix FM

My question is now that I need to re-apply how do I go about it to make sure I don’t repeat the same mistake and losing more money

From the information you have provided, it appears your wife is not a British citizen and therefore cannot sponsor you no matter what form you use!. What passport does she hold?

You need to apply as Tier 2 dependent.

https://www.gov.uk/tier-2-general/family-members

YOUR visa will be dependent on your spouse's Tier 2 work visa.

Looking back on your earlier notes you were enquiring about the Tier 2 dependent visa, and it was YOU that had the Tier 2 visa not your wife.

You were told back in May 2017 to apply using the Tier 2 dependent visa route.
