Default Spouse visa denied

What's the next step if you can't meet the requirements of 18,600?

and if your holiday visa runs out in Canada,do they just expect you to split up with your wife?

If you are flexible and being together is to priority then look up the surinder singh route.

From your earlier posts it appears that YOU (UK citizen) had only just moved to Canada on a spouse visa with your Canadian wife in April 2013.

Are you saying that between April and now you applied for a UK spouse visa for your Canadian wife to move back to the UK?

How can that be? Unless a)YOU were earning above 18600 in Canada AND had a job starting in the UK within 3 months of returning to the UK or b) you have savings of 62,500 and above there is no way you would have obtained a UK spouse visa.

Maybe you should provide further information as to your circumstances.

if you do the option of 16,000 in savings does that have to be in your bank 6 months before application ?

Savings over 16,000gbp can be used to make up any deficit in income using the following formula.

16,000 + (18,600- income x 2.5)

So assuming no income, the required amount would be 62,500gbp.

16,000 +{ (18,600-0 = 18,600) x2.5 = 46,500 }

16,000 + 46,500= 62,500

The savings have to have been held for a minimum of 6 months before the date of the online application.

OP, as SanDiegogirl mentioned, some more information relating to your circumstances would really be useful in terms of being able to provide you with meaningful advice. Currently it is not even clear whether you wish to settle in Canada or the UK with your wife.

You evidently have no idea as to the financial requirements for a spouse visa for the UK.

right i have now sent prove of savings of 16,000

so next problem is the wait of 6 months as they are saying as to be in your account 6 months

would their be a problem of getting a visitor visa to the uk for 6 months in the meantime ?

or would a simple visit while the spouse visa open be a nightmare at the airport and lightly to be refused entry

Having savings of 16,000 GBP is of no use unless you have other resources to use with it. JUST having these savings will NOT get you a spouse visa.

You evidently have not read the document detailing all the financial requirements.

Unless you provide full details of your financial circumstances I don't think we can help you further.

It's being done so the government can provide a headline grabbing figure about net immigration coming down to under 100,000 per annum for readers of the Daily Mail ahead of the next election. They can't stop immigration from within the EU nor asylum seekers but they can clamped on the skilled workers who we actually need and families of British citizens.

They don't seem to realise they have a nice simple option to lower NET migration...
Stop freezing peoples pensions when they emigrate to places like Australia, and suddenly you'd have more emigrants to offset against immigrants.

Anyway, for the OP... As your wife is Canadian, can't she just enter the UK with you initially, and then return to Canada after you've spent 6 months in the UK, hopefully with you getting a job that pays enough to have her qualify for a visa. (Obviously that would mean she couldn't work though for those 6 months)

Otherwise your options are for YOU to get a job paying enough in Canada, while employed there for 6 months. (Her income doesn't count), or if she can qualify for a work visa to the UK, that would be another option.
Other than that, it would be the Surinder Singh route. (Exercise your EU right to take your wife with you and go and work in another EU country, which then lets you use those same EU rights to go and work in the UK and take your wife with you on an EU Family Permit.)
