Hi,

I am new to this forum and have found it greatly informative. Thank you to all who volunteer their time and information. Would kindly appreciate any advise on my scenario.

I was born in the UK in 1976 to a naturalised British father and Malaysian mother. My British child passport expired about 25 years ago and was never renewed after obtaining a Malaysian one.

My child is born in Turkey to a Turkish father and Turkey allows dual nationality. I would like to obtain his British child passport for him.

Msia does not allow dual nationality so I am considering applying for the ROA/COE for my Msian passport as I am not wanting to risk getting the citizenship revoked.

My questions are:
1) Can I go ahead and apply for my child's British passport now without having the ROA in my passport? Will my birth certificate be enough proof of my citizenship? Would this delay or complicate the application?
2) What is the likelihood of being granted the ROA with the fact that I did have a British passport before albeit it having expired 25 years ago?

Q1 - Your birth certificate should be enough as you were born in the UK prior to 1983. Any documents you supplied that are not in the English or Welsh language will need to be professionally translated into either English or Welsh.

Q2 - As long as you don't have a British Citizen passport, you can apply for a Certificate of Entitlement. Since you had an expired British passport, your application should not be too problematic.

Another thing for the OP, she should consider registering her child's birth with the British authorities. Please see link below for details -

1) Yes, that won't be a problem unless your child has already had a British passport. Your birth certificate and your child's birth certificate should be enough evidence. You should also supply your previous British passport if you still have it.

2) If you have already a British passport then you won't be eligible for a Certificate of Entitlement to the Right of Abode. If your British passport was issued 25 years ago then you might get away with it but I wouldn't recommend it.

BritInParis, would you kindly share why you don't recommend it? Perhaps there was an aspect I overlooked while thinking over my situation.

At the same time, I will add that I have also submitted an application for my child's Malaysian citizenship, with his Turkish citizenship made known in the application. If approved, Malaysia will allow the child to hold dual up to the age of 21, after which the child can decide which citizenship to hold.

I suppose I am wondering the best way to go with our British citizenship right without risking the Malaysian one:
1) Either both of us apply for a British passport (risky for me, ok for him under Turkish law, unsure from Malaysian side if his Malaysian citizenship is approved)
2) Or both of us get ROA: on my Msian passport (if accepted), wait out on the child's British passport until we hear back from msian authorities. If approved, get ROA on the child's Msian passport too.

Any advise will be greatly appreciated. Thank you.

Because as you have previously held a British passport then you are not entitled to it, your application could be refused and you would lose US$592.

That's a decision you will need to make - how important is your Malaysian citizenship to you and your child? If you apply for a British passport for your child then he will veto his right to hold a Certificate of Entitlement to the Right of Abode in the future.
