Hi all,
I am british, boyfriend st lucian. I am pregnant and have come back to UK. Boyfriend wants to also come to UK and live and work. How can he do this? Does he have any rights as our baby will be British?
Advice please!

Saint Lucia is an independent nation that is not a territory of any EU/EEA country, so, assuming your boyfriend is a citizen of Saint Lucia and not of any EU/EEA country, he can only enter the UK on a visitor visa or a work visa. Being the father of a British child makes no difference regarding his residency rights in the UK. He will need to have a job already lined up in the UK before he can gain entry on a work visa. A visitor visa to the UK lasts for 6 months, after which the visitor needs to return to their home country.

If you are planning to get married, and if it will be in the UK, you can apply for a fiancee visa for him to enter the UK. After you are married, you will need to obtain a spousal visa for him. In order to get a spousal visa for a non-EU/EEA spouse to live in the UK, you (the British spouse) will need to earn an annual income of £18,600. The reason for this is that your spouse is not entitled to any Government benefits for 5 years, and so you need to show he will be adequately supported. Only those in receipt of certain disability-related benefits are exempt from this very harsh new income threshold.

If you intend to eventually get married and live in Europe, my advice is to move to Ireland, not the UK. Ireland has a far easier family immigration system with no financial requirements and a much shorter time-length until your spouse is entitled to Government benefits and to citizenship.

With the new rules, it'll be tough for you to prove you can support your boyfriend if you are not working. The only real option is for your boyfriend to be sponsored for a work visa in the UK, but again this is pretty hard given the current economic situations and the restrictions on work visas.

The baby will be Saint Lucian by descent and you can apply for Saint Lucian citizenship if you marry your boyfriend, so you might want to consider returning to Saint Lucia for the time being.
