Smile moving back to uk .Wife and boy are cdn cit.

Hello, we are wanting to move to The UK, I am a Brit, wife and young boy are Candian..anyone else doing this or planning on it, or HAVE done it recently?/ need advice, tips..experiences..many thanks

If you are the father of the boy then hes a brit too...you just need to do the appropriate paperwork for him to get in, either a british passport or leave to remain in his UK passport. There is no mechanism to register him as british from within Canada though.

You wife will need to get the leave to remain. No working for quite a while though

Not necessarily - if the OP is British by descent, then nationality does not pass on like that. You need more information before determining this.

Not sure what the "no working for quite a while though" means, however it reads that you're saying someone who has applied for leave to remain as a spouse cannot work. This is not true, they can work in the UK with LTR as a spouse.

British passport or Right of Abode stamp in Canadian passport.

There is no mechanism to register him as british from within Canada though.
No mechanism to get a consular birth certificate, if child is British. Passport or ROA stamp. If child isn't British, then it may be possible to do Home Office registration, this can be done from Canada.

You wife will need to get the leave to remain. No working for quite a while though:
Spouse visa holders may work.

If you are British you boy is most definitely, absolutely entitled to a British Passport. My little girl was born in Canada, to my Canadian wife. It was a simple formality to get her passport. My wife is a Canadian citizen and it cost about $1000 for her visa, but it was a very simple process.

thanks for info, how long did it take your wife to geta visa and when was she allowed to work in the UK once she arrived??

I always find it amusing to see information that is given as "most definitely" correct when in fact it is wrong. If he is a British citizen by descent, then a non-UK born child is not automatically British.

Unclear why so many struggle with this concept as it is well documented and has been in British law since 1915.

I could be wrong as with anything. All I'm saying is that my non British born daughter to her Canadian mother (Born Quebec Canada) was automatically given a British passport last year. All that was required was a copy of my British birth certificate. That is what most definitely happened with me.
