Looking to return to the UK - help!

Hi everyone,

I'm a Brit living in the US with my American husband. I have just applied for British passports for my US born children and am seriously considering moving back to the UK. AS a qualified teacher in the UK being unable to teach here without starting all over is one of the reasons I'm looking to return.

So I just need a place where I can lay out my plans and make sure I'm doing everything right - that way when I convince my husband hopefully I have all my info correct!!

So the kids will be good as they will have British passports, right?

My next plan of action would be to secure a job teaching for the following school year. Then from what I understand I would apply for my husbands visa which would last for 2.5 years. He would have a 200GBP per year NHS surcharge.

Am I on the right track?

Have you think of getting US citizenship before returning to the UK. It will make your return to the US (whether for short visits or longer term stay) easier. With your children being US citizens, they may return to the US one day for good. (You never know!) That is why you should get US citizenship before returning to the UK to keep your options open.

Working in the UK is not the only way to satisfy the Home Office's spouse visa financial requirement. You can also use cash savings. You will need £62500 worth of cash savings for more than 6 months before the application in order to qualify. Money from a house sales does not need to meet the 6 months rule.

All sounds good.

The NHS surcharge will be paid along with your visa fee, it is not paid annually.

The lengthy timescales for visa processing is the problem we are all facing at the moment so keep this in mind if you expect to secure employment and later move at the same time as your husband, you need to allow a *lot* of time for the processing.

OP - how did you intend to meet the financial requirement? I believe you would need 6 months payslips & bank statements for the salaried route. It would not be sufficient to simply hold a job offer.

I am employed full time right now, does that income count if it's US income? We have no savings as we live in a very expensive area and myself and my son have both had health issues which resulted in huge medical bills.

Oh yes I think you can submit that as income, you should also submit your upcoming job contract in UK.

You will need enough savings to show that you can accommodate yourself for one or two months when you arrive. To expand:

1) You should be able to show that you will be able to maintain and accommodate yourselves without recourse to public funds for at least the first month if you have employment pre-arranged or two months if not.

2) It is not a requirement to have permanent accommodation pre-arranged. The visa applicant and spouse/partner must, however, have plans for securing their own accommodation (questions about this may arise during the visa interview).
