ILR visa category F (self-employment) financial evidence
Hi everyone! I am married to British Citizen and applying for ILR under category F (self-employment for the last full financial year 2021-2022). He will be my sponsor.
I had a private consultation about our case and it was useless, so was gov.uk helpline and my husband's accountant. I am pregnant and my due date is very soon so I really need to be done with this, this forum is my last resort! Please please please help.
1. Evidence of the amount of tax payable, paid and unpaid for the last full financial year - the accountant provided a Tax Summary (page 14 of SAR) for that, as well as the HRMC web page that states how much tax he owns for this year and also a balancing payment for the next year. My husband didn't pay any tax yet. Will these documents work as evidence? Also, the HRMC page is dated back to November when he've done the accounts. Is that ok that the date will be not within 28 days from the application date?
2. Does my husband have to pay his self-employment tax before I submit the application? The due date for his tax is 31st of January.
3. The biggest pain in the ... is the If the business is not required to produce annual audited accounts, unaudited accounts for the last full financial year and an accountant’s certificate of confirmation, from an accountant who is a member of a UK Recognised Supervisory Body etc. - his accountant provided the document called "Unaudited Financial Statements". It contains an accountant report, profit and loss, balance sheet, and tangible assets. Is that the same as Unaudited Accounts?
4. In regards to an accountant’s certificate of confirmation - The Unaudited Statements report states: In accordance with the instructions given to me, I prepared without carrying out an audit the annexed financial statements from the accounting records of NAME and from information and explanations supplied to me.
Accountant Signature,
Accountant Company,
Address.
Date: 15th November.
So as I understand it is NOT a certificate of confirmation that the accounts are genuine. Nor it is seen anywhere that the accountant is a member of approved institutions. Am I correct that we should request another confirmation? If yes, any example of what exactly it should state? And does the 28-day rule applies to this letter? PLEASE PLEASE HELP.
5. In the Unaudited Statements document it says "Financial Statements for the year ended 31st March 2021" - how come it's not April? Is that a mistake? The accountant refuses to explain this.
6. In regards to the on-going self-employment - do we need the 3 months' statements that end within 28 days? Or can it be ANY bank statement within the period of the last 3 months?
7. What was the income (in GBP) from self-employment in the last financial year? - in my husband's return, there are different numbers under Total Taxable Profits and Net Profits, while I have the same numbers on mine, so I am confused about which one is the income mentioned above.
Thank you!
