We are currently in the US, and my husband has his first BRP. We have stayed in the US due to unexpected medical issues that required immediate treatment. If the Spouse visa expires while we are still in the US. Can we apply again or do we need to wait a number of years for reapply?



Does anyone have experience in getting a spouse visa, not using it, and needing to reapply?

There is no waiting period to apply for another spouse visa, and having a previously expired visa will not affect your new application.

You can apply again at any point from the US but any time accumulated toward ILR will be lost.

Looking at the OP's older post it looks like that although they obtained a spouse visa, they have never moved to the UK .....

Thank you all for your responses. I am feeling a bit lost as, yes, we picked up my husband's card in May and spent a very short time in the UK. I received the results from my US Doctor (not good) and decided to get medical treatment in the US. We have been in the US for nearly 6 months, and I am worried that if we stay beyond that, the hubby's visa will expire. We intended to stay in the UK, but the medical diagnosis. All our plans came crashing down. We bought a house, which is still waiting for us, a silver lining I am holding onto. I am concerned that if it expires in the US and we reapply, the Home Office will frown on it and possibly deny the visa. Thank you again for your responses. I have been a long-time reader of this site since moving stateside 23 years ago. You have comforted me when feeling homesick, and this is a great community for advice!

A spouse visa is valid for 2.5 years.
If it expires you will be able to re-apply without any issues.

You should have another couple of years to return to the UK before it expires so hopefully your health improves so you can make your permanent move within that timeframe and renew your husband’s visa in the normal manner.

Sorry to hear about your condition.
Look at the BRP card. It will say, 'valid until' that is when it expires. It does not matter how long you are outside the UK before that date. But must be in the UK to apply for an extension.

If the visa expires while you are outside the UK, it will be a new entry clearance application your husband will have to make.

You can work on the visa will outside the UK to be ready to submit when you enter. If it your intention to do that, start 7-6 months before the visa expires to give you enough time to put the documents and application together without stress.

It’s unlikely that the BRP’s expiry date matches the expiry date of the visa as all BRPs will expire no later than 31 December 2024 ahead of the Home Office’s scheduled replacement of BRPs with eVisas.

The OP should check the expiry date of their visa in the decision letter or email they received when the visa was issued or use the link below to view their immigration status for the correct expiry date which is likely to be in late 2025 or early 2026.

Yes, you are right. If the expiration date on the BRP is 31 Dec 2024, it means the visa is valid beyond that date and then the link you have provided is the way to go.

If it is the case as you have also mentioned, late 2025 or early 2026, hopefully they would have been back to the UK by then.
