hi to all and pls . help me as i have only one month more before i go to pakistan and help my wife put up the appliction.hi im a uk resident and want to sponser my family from pakistan'. i have been to several lawers and im confused one says apply for spouse visa another for fiance visa and the third one suggests ishould apply for un married partner visa. here are my details pls. help as im scared of refusal thanks in advance.
i was married to xwife who was eu national[spanish].
recieved my ilr on married bases in 2004.and obtained decree absolute in 2007 ,but i got islamic nikah in pakistan in 2004 and have two children son
is nearly 7years old and daughter is nearly 4years old. . and my wife is expecting inshallah on 23d may 2012 our third child.
my last marriage broke up because the x never wanted to have children and i told her iwant kids she allowed me to have kids in pakistan with second wife as long as she stays in pakistan and doesnt come to uk.i agreed and did nikah in pakistan.In next three years of nikah iwould visit my wife in pakistan and my x was not very happy about it so we broke up and divorced.Now im faced with this problem what is the best corse of action and which category to apply as lawers tellme idid nikah before decree absolute and cant apply as spouse visa so pls tell me which visa ishould apply spouse;fiancee or unmarried partner and what are my chances as my my wife is expecting our third child inshallah on 23rd may and i want to travel to pakistan approx.on 15th may and apply for visa of my family straight after birth of our baby i have about three months bank statements with £600 to £700 per week going in and a saving of about £3000 over a period of three months though i work in london but i have rented a 3bed house in leeds as its too costly to rent in london iwant to know is that objectionable as i work in london and proposed accomodation for my family is in leeds i plan to say in my letter that iwill be visiting my family on weekends is this classed as our accepted as living togather as one lawer says its not acceptable and the other says its ok.I have already installed bt land line and internet connection as proof of bt bills as utility as the land lord shares the accomodation as its a four bed house and all other utility bills are in his name but £435/month rent shows as house rent on my bank statement i have been to pakistan to see my family 2 or 3 times every year since 2004 is that proof enough for eco of my relationship with my partner if i go ahead with fiancee or unmarried partner route has any one applied in these catogories as in my case before divirce and got visa pls. help me as time is running out for me and if i need more proofs can you all pls.help as my children are finding it very difficult to live away from there baba[father] so pls. all help me to a successfull visa inshallah thanks.

I have moved your thread over to our Moving Back To The UK forum. I'm not sure whether anyone on BE can help you as we are mostly British citizens...therefore we don't really have the same issues you have. that someone who reads this thread will be able to give you answers to your questions.

Hi Huntter.

Firstly, my sympathy to you. Obviously it is very important to get your application right, and very confusing if you are getting different advice from different lawyers.

I used to be a lawyer in the UK, but I'm not going to give you legal advice, because I did not practice immigration law, and anyway I'm retired.

However, your problem is a legal one, and it is not going to help you getting advice from a non-lawyer on this forum either.

I wonder why the lawyers you have asked for advice have disagreed. Maybe you should look at their qualifications and decide which was the best qualified to advise you. Were they all solicitors or barristers? Were they listed as specialists in immigration law? It is unusual for lawyers to have such wildly differing opinions about the law, as you describe.

Why did you seek more than one opinion? When seeking legal advice, it is sometimes tempting to keep "shopping around" for lawyers until you find one who says what you want to hear, but advice that is pleasant to hear, is not always the best advice.

If you are in London, I can recommend a firm of solicitors that specialize in immigration law, if that will help.

Well none of us are perfect. I spelled practice with a c, when I should have used an s -- practise, and I should have known better.

After living in the US for 16 years I also get mixed up with the 'c's and 's's....licence/license...practice/practise etc.

..... and according to the OP he 'married' his second wife (put in Italics because it was an Islamic ceremony so don't know if it is recognised in the UK) before he was officially divorced from wife no.1.

To the OP -you have a partner, 2 children and another child on the way. I suggest you have a lot of money to prove that you can provide support for them when you put in your application (whatever category you think you are eligible for).

Personally I don't think you have much of a chance of success.

Honestly, while I agree that the OP probably won't have much luck if only because his situation is very specialized- and complex, I don't see how overcrowding really comes into it. I doubt very much that a family of five would single handedly collapse the system if adequately provided for. I get more than enough of this kind of argument against immigration here in the US- its moot. If people are trying to come to a country legally, then that should be supported- not discouraged with unproven blanket statements seeking to blame one individual for the problems caused by the many - as you did here. OP, good luck on getting a visa for your wife, I'm sorry I can't offer more in the way of advise.

hi to all again and thanks for all the replies
Though some were very discouraging and some talking about UK bieng overcrowded.
I can say alot on overcrowding but im not here to argue good luck to you if you think that way.
do the people of the country you have moved to say the same thing about you bieng there im sure they do and what have you got to say to that and whatever you think your answer would be to them,will be my answer to you if i bring my family to UK and you think of overcrowding.
As far as ILR is concerned what makes you think my first marriage was to get ILR.Just to let you know that The x wife proposed me for marriage and have you heard about 14 years residence rule that grants One ILR on this bases.
So if you cant help than i rather not have any answers from people like yourself
who have biased backround related opinion.
I hope that gives you some food for thaought .

Can't you do a legal wedding with the wife with the children and go from there? If the Nikah wedding isn't recognized? Are you on the Birth certificates of all the children. If so that and the wedding certificate should be a good start.
Did you get UK citizenship?
