Question Genius required: Spousal / ILR + travel

Hello lovely people,

My wife's spousal visa is due for renewal in January 2024. We can either extend or go for indefinite leave to remain.

We want to travel from September until December (or longer if possible), but don't want to affect our visa.

Will this time out of the UK impact our application for extension or ILR? What are our travel limits?

For extra information: we are married and own our home + have full time jobs (looking to take a sabbatical).

When did your wife first enter the UK on her initial spouse visa? What is the validity start date of that initial vignette?

Hi there, thank you for your reply BritInParis!

She arrived in June 2018.

Can you elaborate on the vignette? I don't know what that means.

She came over on a 2.5 year which has been extended 2.5 years. She's due to renew or get ILR in Jan 2024.

A vignette is the paper visa sticker she received to enter the UK before collecting her BRP.

If she arrived in June 2018 then she’ll be eligible to apply for ILR now. You don’t need to wait until her current BRP is close to expiry.

I would personally consider an immediate application for naturalisation as soon as her ILR is approved and that way you can spend as much time as you like outside the UK without consequence.

That's great, thank you. We'll take a look in to that, but I guess it will have to be finances dependent.

Is that possible for us to travel before our application? Or will our ILR application be impacted because we've travelled in the preceding months?

We'd like to travel before the expiry of her current visa:

September - December - out of the country

January - Return to the UK and apply for the ILR (shortly before expiry)

It could definitely be an option. It looks like it costs £500 additional to have it processed within 5 days.

I've read on the website is that you can apply "28 days before you're eligible". How do we know she's eligible to apply for it?

Your wife would need to complete five years residence and she can apply up to 28 days prior to the fifth anniversary of her arrival date so if she arrived in June 2018 then she already meets the residence requirement. If she is a Canadian citizen then she meets the English language requirement so the only outstanding thing would be the Life in the UK Test.

Hi BritInParis - thank you so much for the advice! We've gone ahead and applied for ILR - exciting times! Can you please help me understand what to do with the Life in the UK test? My wife is studying right now. When do we have to complete the test and how to we tag it on to the application?

She really ought to have completed it before you submitted the application - when did you schedule the appointment for?

She already had her appointment last week. When applying, the form asked if we’d be willing to complete the test if it was required. The person at the appointment wasn’t sure whether or not we’d need to complete it.

The Life in the UK test is mandatory so she’ll definitely need to complete it. I would get her to pass the test as soon as possible and hope the ECO requests her URN rather than just refusing the application outright.

My wife completed the Life in the UK test and passed. Is that test submitted automatically or do we need to send the details somewhere? We've searched and there doesn't seem to be a way to contact them.

Have you not had a response from the Home Office yet? Did you pay for Priority? The application form asks you for the URN. What did you answer for that question?
