Family / Spouse visa for IT Professional
 
Hi,

I am an IT professional Indian and currently working in India, my wife and 2 kids have Portuguese Nationality and recently (1 week of July 2018) my wife and daughter shifted to UK. My minor son 12yrs also has Portuguese Nationality and he stay with me in India just that wife will settle and I will move with my son. My wife has started working but she is not having salary that qualifies her for £18600 requirement. Apart from this I have few more below details which I feel is positive in our case.

1) In my wife bank account, she has saving of Indian currency equivalent to £15000 + in her various bank accounts since more then an year. I will submit all those bank attested documents
2) I have recently sold her property in India, and that money is again appx £20,000/- + is about to be deposited in account in next 2 weeks, which I am going to transfer in her UK account.
3) I am working as Project Manager in an IT company and having experience of 13+ yrs, IT profession is one of the skill listed in UK Shortage Occupation List details.
4) I have visited on tier2 visa in UK in 16-17 , where my visa was valid for 1 year but I finished my assignment in 4 months (worked for one of the Giant Bank of UK) and came back in 4 months.
5) My current Indian salary is much more then the threshold of £24K, but I believe they don't consider dependent salary
6) Financially my bank statement and salary slips shows a sound financial background.

Now Queries.
1) Should I apply for Spouse Visa or Family Visa (or both are same) ?
2) Since my bio metrics, my records, my earlier application is with UK embassy so will it create a sound case for me ?
3) I know application process, documentation but still should I seek help from UK attorney ?
4) Since my wife who is initiator of this visa, and she do not qualify for minimum threshold of £18600, + one child (appx 21K) so her lower salary would impact my application? (I mean possible rejection).
5) Saving in Indian Banks would be considered or saving should be in UK banks only.

Appreciate if experts can help me on above queries, I have gone through various post on this site and got some idea on things, but I did not see any post done by IT professional. I got to know property sold and money transfer could be consider as saving and no need to wait for 6 months saving in UK bank account so hoping that would solve my issue, but still experts guidance is required before proceed for any application.

You're not eligible for a spouse visa but you are eligible for an EEA Family Permit which is much preferable as it's free and does not have any financial, accommodation or English language requirements attached to it. So long as you apply when your wife has spent less than three months in the UK then you only need to provide your passport, your marriage certificate and a certified copy of your wife's Portuguese passport.

An EEA Family Permit is only valid for six months so you should apply for an EEA residence card as soon as you arrive. Be aware that this can take up to six months to process and you will be without your passport so you should take a photocopy of your passport and your EEA Family Permit as evidence of your status and you shouldn't make any travel plans until you receive your passport back.

Thanks for your quick reply, so this means if she will complete three months then we cannot apply for family visa?
