Default Expat Moving to UK with spouse and 2 children under 18

Hi Everyone,

Maybe someone can help me with clarity on my situation.

Little bit about myself: Born overseas to British Father who was also born overseas. Managed to get British Citizenship but have never lived in the UK for long. Currently have non EEA spouse and 2 children born outside the UK. Children are not entitled to British Citizenship or Ancestral.

Question is regarding the children on returning to the UK on a dependent visa.
1) After the initial 2.5year visa do I apply for another extension?
2) After the extension when can I apply for citizenship for them? I have heard after 3 years of continuous residence they can apply but what does that entail?

1) Yes
2) After three years you can apply to register them under S.3(5) BNA 1981 which will give them British citizenship otherwise than by descent.

Can the children apply straight for ILR before coming over if I am a British Citizen?

If both you and your wife were British citizens but you were both unable to pass it on then your children could apply for ILE before they moved to the UK but as your wife will be on a spouse visa then the children will need child visas.
