Canadian child visa with Brit-by-descent parent
Hi,
I've posted here over the years, and want to make sure that I have the process clear before taking the plunge again.
I am Brit-by-descent. I lived in the UK before my children were born, but not for 3 continuous years (I thought that I had, but did not. It was 3 years broken up over time).
I am a single parent (no custody issues).
My children are Canadian only. We are living in Canada right now.
My first question is, is this correct?:
1 - I will need to provide proof of savings (which is approximately 65K UK pounds).
2 - I am confused about the terminology on the UK government website regarding a non-UK child applying for a visa. It refers to having family settled in the UK. This is our situation: We are living in Canada. I do not have a partner. I am the sole legal custodial parent. I am not presently settled in the UK, although I have the right to be because I am a Brit Cit by descent.
Do I apply for an Indefinite Leave to Enter visa for my children?
My next question is, will the following past history negatively affect their application? Our history is:
We were refused twice under the Surinder Singh route. (2016)
We returned to Canada in 2017.
My sons were held-up at the border when returning in 2018 (as visitors) both when arriving from Canada, and again 1 month later when returning to the UK from Spain. Their passports were stamped with a 6-month limit (no recourse to public funds). We returned to Canada and have remained here since then.
