Can you apply for the spouse visa from the U.S.?
Currently we all live in the U.S. And really don't want to be separated, we are going through the the saving route so proof of income shouldn't be a problem but the website implies that the British person lives within the UK.

It's just bad wording on the apply to join family in the UK site.
The British spouse is deemed to be settled as soon as they set foot in the UK - the non British immigrant is "joining them".
Using savings to apply will mean you travel to the UK together - you as British citizen, they as immigrant with visa.

I really wish they would change that wording!
It has caused confusion for countless people in this situation and it is so very unclear.
