Apologies in advance as I'm sure there are tombs of web pages I can look through but with a new baby around I seem to always doing something else. I wasn't fully aware of the rules when we arrived and after all the changes I'm even more lost and I was reading a post about needing 5 yrs of ILR?

Story is this:

I am the UKC and wife is Australian citizen.

Arrived in the UK March 2010 with her on a Settlement Visa.

Wife took Life in the UK Test either late 2011 or early 2012 (can't remember).

Applied and was granted ILR late Feb 2012.

Overal has spent about 4 mths out of the country on various trips and holidays, some with me, some without.

My understanding is that because she arrived pre Jul 2012 she only needs 3yrs residency with one of those years as ILR to be able to apply for UKC. Which effectively meant she was eligible last March or so.

Have I got that right?

Mrs TB can't have spent more than 90 days out of the country in the last year and no more than 270 days out of the country in the last three years. So long as she meets those residence requirements, from what you've said, it sounds like she has been eligible for the last year or so.
