Hello!

I am planning to apply for my visa extension in November but I want to spend Xmas with my mom, she lives in Austria. (My first BRP expires on Jan2021)

Can I leave the UK while my application is under review? I know I can keep the passport but I don’t know if I can leave the country for 10 days, but I don’t know if this is going to affect my process.

Unfortunately not. If you leave the UK then your application is automatically cancelled. However since your BRP doesn’t expire until January then I would apply after you return from Austria.

Yes; you would likely fall short of the five years for ILR and there’s no guarantee that you’d get your new BRP in time for Christmas. I appreciate you would probably prefer to get it done sooner rather than later but it’s actually best to apply within 28 days of your BRP expiring so you can ensure you have the maximum leeway at the five year mark.

Sorry to ask this but as my first residence permite expires in Jan (21st 2021) how can I keep working? I think the company that I work for will ask me to update my work permit.

What can I do when that time arrives?

So long as you have submitted a valid application before your current BRP expires then you are allowed to continue working until a decision is made on your application. Your employer should be aware of this and can run a free online check with the Home Office to confirm your Right to Work if they wish to.
