Aussie moving with Uk spouse to care for elderly mother in law
Hi, new here and need advice. I am a 65 yr old uk citizen (hold uk and aussie passports and receive uk pension ) and have been married and living in Australia with my Australian husband for last 20 years. We now need to move to uk as live in carers for my 88 yr old mother who has had a stroke.
We are naturally unsure regarding the length of stay (in family history some have lived to 100). Ie it will probably be for more than 6 mths.
What type of visa does my husband need under these circumstances?
Currently my mother has a paid live in carer and is not receiving any 'benefits carer payments', due to her financial circumstances. However it would be no problem to prove that she has to have a carer, doctors would be happy to help.
Wiki covers children but not elderly?

Well the choices of visa are either visitor's visa or family of a settled person visa, commonly known as a "spouse visa", there is no other visa between a short term visitors visa and a potentially permanent settlement visa.
If your husband has recent British ancestry he might be eligible for an ancestry visa, but he would be required to be willing to work, in other words the visa isn't available for retirees.

Thanks for quick reply. Seems my husband will need a spouse visa. Next question, we can apply from Aus or uk. Which is best?

A spouse visa must be applied for from your home country/ outside the UK. If the immigration officer when you arrive in the UK suspects that a visitor (without an appropriate visa) is coming to live in the UK they are likely to be denied entry.

Again thanks for quick reply.We have visited uk annually for last 20 years, with no problems, so why couldn't my husband apply once for eg he has been there for 3 months?

There is nothing to stop your husband applying for a visa, then visiting the UK for three months, then returning to Australia to complete the visa process. AFAIK he could even mail the application to Sheffield while in the UK, but he would still have to return to Australia to receive the visa.

You cannot apply for and obtain a visa from within the UK, it isn't possible.
There is nothing to stop your husband applying for a visa, then visiting the UK for three months, then returning to Australia to complete the visa process. AFAIK he could even mail the application to Sheffield while in the UK, but he would still have to return to Australia to receive the visa.
