What you believe and what is happening can be two different things. Have you considered what happen if your wife's asylum application fails? Her chances of getting a visa to enter the UK after this would likely to be nil even under a 'new' identity, as the government took figure prints of asylum seekers and visa applicants.

There are a number of suggestions made here re SS and going back to the UK to get a job that could satisfy the finance requirement. You should consider these before going down the asylum route

Jeepers ppl, it was merely a question. Now everybody has their knickers in a twist about circumventing geneva conventions, etc...

But indeed you are talking about planning to circumvent Geneva conventions.

Asylum treaties were conceived so that people who are in immediate DANGER or in fear of PERSECUTION in their home countries would be able to seek shelter/asylum/sanctuaries in other countries.

Your situation doesn't fit those two bold words.

Oh and I'm from the Philippines, a third world country.

Quite. And the question has been answered comprehensively, with some excellent links and references that another poster took the time & trouble to look up & post for you, AND a reply from someone with professional experience in the field of immigration, I believe.

As this is BE - a public message board - you also got a (very small, polite & remarkably restrained in the circumstances) side-helping of *opinion*. I do not read any "passing [of] judgement".

I'm sorry you didn't like the answers, but "shooting the messengers" won't change 'em.

You come onto a forum to ask advise from people who specifically know about issues on moving back to the UK and you respond to them like that !

I'm sure England is a better place without someone as rude and arrogant as you.

And once her application fails, she (and her family) will be hit with the new Immigation Act 2104, designed to stop the abuse, with no housing (landlords fined if they house her even if her name isn't on the tenancy). The OP will have to dig deep to cover all his wife's healthcare bills as there will be no free NHS for her (hospitals and GPs to check from April 2015 to stop NHS abuse although many have already started); no free NHS in A&E either (that is stopping in England); no working; no welfare; no driving. Even the abuse of people trying to use Human Rights to try to stay in the UK have been severely limited under that new law.

The OPs claim for welfare for his children will be affected by his wife's non immigration status and if he tries to claim as a single parent, he will have commited the criminal act of benefit fraud.

Then when she (and the OP) finally realises she has to exit the UK and return on a spouse visa or through the EU SS route, she will have messed up her immigration history and will fail the new Good Character requirements. Committing an immigration offence, exiting the UK and coming back in legally, being forgiven and granted UK citizenship, has ended under new laws and these people now have a 10 year ban before they can meet the Good Character requirement. And following a recommendation from the head of UKVI, now every application, their previous application claims, their immigration and criminal history ect is now being checked for every applicant and deception on any application carries a 10 year ban.

At no point did he say that the family were planning to break the law, he merely asked if asylum was an option.

Unless you are walking in his shoes, or have proof that they were intending to enter illegally, then you have no right to judge.

its no wonder the forum is quiet these days - we are supposed to be helping people, not driving them away.
