Apply for Spouse Visa from Country other Than Own
Hi I'm a British citizen married to a US citizen. We have been living in the US and are currently here in the UK for a few months visiting family. We are thinking about moving back to the UK and know all the financial rules. But one thing we are not sure about is that we know that my US spouse would have to apply for a spouse visa from outside the UK but does that mean he has to apply from his own country? Or can he apply from any other country? We were thinking about going over to Ireland for a while. Would he be able to apply from there? We do know about the Surinder Singh route but don't want to do that if we don't need to. Many thanks

As far as I know you must apply either from in your home country or in a country in which you are legally resident. So it appears you would not be able to apply from the US as you are only visiting. Not sure how it would work to go to Ireland, especially if you don't want to go the SS route, which might come to an end soon anyway.

He must apply from the US or somewhere where he is legally resident.
He can't apply from Ireland.

If you were planning to move to Ireland to live and work then applying from there would be an option. If you were only there on holiday then your husband should return to the US to apply for his spouse visa.
