Hey there! I got married on the 25th of February this year to a UK citizen. I was on a visitor visa, and we flew to America to on Th 6th of March (my home country) for an art show he is putting on in April. Unfortunately he was denied entry by customs because they suspected him to be trying to immigrate despite him having a work visa. He had to fly back and I've been back at home trying to figure out our options. We've already petitioned him for a green card and that's just a waiting game now.

So here's what we want to do,
-fly me out to the uk
-have me stay in France for a few days while my husband applies for the spouse visa in person.

The problem with everything is that my husband is a freelance artist and I've heard it's really hard to get everything approved with that, I think it would be hard to prove that he makes enough each year as well. So what we are thinking of doing is me flying out there while he interviews and searches for a payrolled job. And then setting up the meeting. I know we can't change my status if it's just a visitor visa, would that apply if I was staying outside of the country? And how long do you have to wait for the visa after approval? If I have to go back home to the states that's ok too but would like some guidance. It's really hard being away from my husband. Thanks a bunch

1. You married on a visitor visa. While that can still happen these days it's frowned upon as you should have obtained a marriage visitor visa.

2. You need to apply for a spouse visa for the UK from the US (your home country)

3. Once husband has job he needs to be in job for 6 months minimum before you can apply for the spouse visa as he needs to provide 6 months of payslips, bank statements, employment contract etc.

4. You can visit while he is working his 6 months, but must return to US to do application.

5. Read the following document regarding financial requirements carefully to see how you best qualify:

6. If you pay for priority service the visa process, once application has been made, could be as short as a month.

How did he get refused entry to the US if he has a valid work visa? That does not make sense.

Ah man! Wow. So this just doesn't even seem like something we should do... We actually didn't intend on getting married, it just kind of happened, I didn't know it was frowned upon :/ does that make the process more difficult for us? I think we might just wait out the time I spent there (117 days) and then meet in Tokyo in July for a month and then go to the uk and I'll just stay with him for 5-6 months while we wait for his immigration visa to go through. The whole point is really just for us to be together some how during this.

It was weird, we got married about 2 weeks before we went to LA and he had letters and proof he was there for this art show. And they turned him away, didn't even let me say good bye to him or talk to him. Escorted him out with hand cuffs to a jail cell where he slept on the floor and had a bucket to piss in. It was truly traumatic.

Can I suggest that you also post in the US immigration section of the forum about this? It's just that it's all a bit odd, as you say he had a valid work visa? Or was he trying to work illegally?

So I'd post there too, and check that this won't have any repercussions on your plans to move to the US, or even plans for him to visit again, if he was refused entry or deported.

I got the impression that "being there for the art show" probably means just that..... visiting for an art show - no work visa. So entering with a new wife raised the red flags......
