28 day/8 weeks
Hi, we’ve submitted my partner’s visa (remain with family) and documents but looking Back we’re afraid we have something wrong. The visa was submitted 28 days before the expiry of the current one... however, with potentially 8 weeks waiting time that means he could be here illegally for 4 weeks?! This is very scary for us as I have a newborn and would mean his job is in jeopardy.
Weve considered recalling the visa and doing the day one but I think we’d lose all the fees already paid and we can’t afford to do that.
Any advice gratefully received!

No, that's fine. Providing the application was lodged before the expiry of his current visa then your partner can remain in the UK on the same conditions until a decision is made. Most people will have their visas expiry whilst they wait for a renewal unless they pay extra to apply in person.
