Default UK Earnings On Canadian Tax Return

Hi,

Myself and my girlfriend left Canada in September 2013. She is a Canadian citizen on a temporary working visa in the UK till 2015. She started work in October 2013 in the UK.

I am British and was on a working holiday visa in Canada, I worked till September there, then started working in the UK in October 2013. My Sin number has expired.

Do we need to put down our UK earnings on our tax return?

You, definitely not. You will put the day you left Canada on your tax return and just report your earnings up to that date. Prorate the personal amounts on schedules 1 and 428.

Your girlfriend can take one of two approaches. She can claim to have become a non-resident in September and follow the same procedure.

She can also maintain her Canadian residence for tax-purposes. She would then include her UK earnings on her 2013 Canadian tax return and apply for a foreign tax credit for UK tax paid.

The former is easier. The latter can get messy but is probably technically correct. The CRA can argue that as she only has a temporary visa she has not relinquished residential ties to Canada.

In her shoes I would be tempted to go non-resident and deal with the consequence in the unlikely event her returns are questioned. Without meaning any offence, as long as she is paying tax somewhere I think she is too small fry to attract much interest from the CRA.

Ok perfect, thanks for your help! It's more so because she will be sponsoring me, maybe I should have mentioned that. We earned very little last year though 14k each in canada.

As she will need an option C printout from Revenue Canada for the last tax year for spoual sponsorship, she may want to file in Canada.

Yeah she is going to file in Canada, but does she need her UK earnings on there too. It is a small amount less than 2k$
