T4 Concerns

What is the consequence if the employer refuses to send in my T4. Fyi, my employment didn't end with a happy ending despite the fact that I formally tendered my resignation. In fact she didn't even pay me for the last week I worked with them. I plead to them to pay me but to no avail. It seems that they want to make things difficult for me after I left them. Now my fear rests on their refusal to send in my t4 slips which I need to file my income tax. Please advice...I'm here in Canada for only 8 months.

Sorry to hear that

Dont worry about the T4 for now, they wont be issued for a month or so usually (end of feb is my experience). Make sure they have your current address and keep in contact with a friend still there if you can to see when the employees get theirs. Its unlikely they will create a problem for you as they have a legal obligation to do it. I believe you can file without it anyway, taking info from your pay slips, but obviously thats a major inconvenience.

Your rights (for ontario) can be found here
They have certain other legal obligations which it sounds like they have overlooked.
If you are in Ontario the ESA says that under normal circumstances they must pay you a weeks termination if they "fired" you ( for your 8 months), nevermind the week you worked, and give you your "Record of Employment" promplly so that you can apply for any EI or benefits within the prescribed limits.

If they dont fullfill their responsibilities, communicate with them through a lawyer specialising in employment law, or at the very least contact the ministry of labour as detailed in the link.

The employers responsibities are listed here:
