Solemn declaration common law
 

Dear reader,

My partner and are hoping to apply under common law.
The 'statutory declaration of common law union' form, asks in section 5:"solemn declaration", for a commissioner of Oaths (name) and signature.
Can anyone please shed some light how to obtain this and if it is vital, or even explain who a commissioner of oaths is?
your response is much appreciated as it will enrich my general knowledge. :rolleyes:

A comissioner of oaths is basically a justice of the peace. They can officially notarise statements for you etc...
They are basically saying that they want a statement by you (and your spouse) that is notarised and legal under Canadian law that you are INDEED common law spouses.

Yes Siren is right. I did the same thing, we wrote a statement saying when we met, how long we'd been together etc. We also got statements from friends and family to support this.

We then had it signed by a lawyer, who luckily did it free as we're friends.

We completed form imm5409E and had no problem, we phoned our local solicitors and they signed it for a very very small fee.

We sent our forms in last Dec, received AOR in Feb. BUT the one thing we have seemingly ommited is any signed notorised (i'm starting to hate that term!) document stating that we are common law partners.
Of course we are, we've been together for twelve years and have a 3 year old son.
Will the birth certificate of our son (which of course has our names on it) be sufficient for CIC do you think?

Do you think there maybe a chance of our application being rejected because of this oversight!? We've heard nothing fron London since the AOR.
